We are on the same wavelength. I have already authored a Bill modeled after Texas AB1676, but unlike Texas that has legislative intent, New Mexico has none and everything has to be spelled out (see Bill below). I simply have not had time yet to find a sponsor. Having said that, if I were a professor at UNM asking for a grant for a SPECT scanner I might have half a chance, but I really don't think there would be much interest in providing public funds to support the efforts of a private enterprise to prove something so that eneterprise can have access to more public funds (Medicaid).

Furthermore, how many times do we need to prove this? SPECT and PET are invasive procedures, and frankly, the last thing New Mexico brains need is more radiation., but keep on with the ideas!

Proposed Bill for New Mexico:

AN ACT

 

RELATING TO HEALTH INSURANCE; REQUIRING COVERAGE FOR 

NEUROPSYCHOLOGICAL TESTING AND TREATMENT; AMENDING AND

ENACTING  CERTAIN SECTIONS OF THE NMSA 1978              

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

 

    Section 1. A new section of the Insurance Code, Section 59A-22-

42 is enacted to read:

COVERAGE FOR NEUROPSYCHOLOGICAL TESTING AND TREATMENT.--

    A. Each individual and group health insurance policy, health care plan and

certificate of health insurance delivered or issued for delivery in this

state shall provide coverage for Hyperbaric Oxygen Therapy,

neuropsychological testing or treatment, or community reintegration

activities necessary as a result of either a traumatic brain injury, aquired brain injury or any other disorder affecting the central nervous system, including but not

limited to stroke, cerebral palsy, multiple sclerosis, anoxic encephalopathies, or any other autoimmune or other disease affecing the central nervous system.

 B. Coverage for the testing, treatment, and actvities may be subject to

 deductibles and coinsurance consistent with those imposed on other benefits under the same policy, plan or certificate.

 C. The provisions of this section shall not apply to short-term

 travel, accident-only or limited or specified disease policies.

    Section 2. A new section of the Health Maintenance Organization law, Section 59A-46-44, is enacted to read: COVERAGE FOR NEUROPSYCHOLOGICAL TESTING AND TREATMENT.--

    A. Each individual and group health maintenance organization contract delivered or issued for delivery in this state shall provide coverage for Hyperbaric Oxygen Therapy,

neuropsychological testing or treatment, or community reintegration activities necessary as a result of either a traumatic brain injury, aquired brain injury or any other disorder affecting the central nervous system, including but not limited to stroke, cerebral palsy, multiple sclerosis, anoxic encephalopathies, or any other autoimmune or other disease affecing the central nervous system.

 B. Coverage for the testing, treatment, and actvities may be subject to deductibles and coinsurance consistent with those imposed on other benefits under the same contract.

Section 3: 59-23-4 OTHER PROVISIONS APPLICABLE.

59A-23-4. Other provisions applicable.

A.  No blanket or group health insurance policy or contract shall contain any provision relative to notice or proof of loss or the time for paying benefits or the time within which suit may be brought upon the policy that in the superintendent's opinion is less favorable to the insured than would be permitted in the required or optional provisions for individual health insurance policies as set forth in Chapter 59A, Article 22 NMSA 1978.  B.  The following provisions of Chapter 59A, Article 22 NMSA 1978 shall also apply as to Chapter 59A, Article 23 NMSA 1978 and blanket and group health insurance contracts:  (1) Section 59A-22-1 NMSA 1978, except Subsection C of that section; and  (2) Section 59A-22-32 NMSA 1978.  C.  The following provisions of Chapter 59A, Article 22 NMSA 1978 shall also apply as to group health insurance contracts:  (1) Section 59A-22-33 NMSA 1978;  (2) Section 59A-22-34 NMSA 1978;  (3) Section 59A-22-34.1 NMSA 1978;  (4) Section 59A-22-35 NMSA 1978;  (5) Section 59A-22-36 NMSA 1978;  (6) Section 59A-22-39 NMSA 1978;  (7) Section 59A-22-40 NMSA 1978; and  (8) Section 59A-22-41 NMSA 1978.  (9)Section 59A-22-42 NMSA 1978

An idea might be to go straight to your state legislators. I have a data

bank with email addresses for almost every state legislator for every state.

Below are the email addresses for New Mexico.

It might be worth a try to put together a "presentation" of your case. You

might even want to lobby them to fund a SPECT imager so as to prove the

efficacy of the Hyperbaric Oxygen Therapy.

Currently, the pediatric neurologists throw their hands up and say there's

nothing they can do--so nothing is ever done. This nothingness is

compounded by the fact that pediatric neurologists have the credentials

that--on paper--says they are the experts of brain-injury in children.

Now, when the most severely injured children get nothing to improve their

brain-injury, they eventually become wards of the state, and according to

the CDC paper those kids will cost taxpayers and society $503,000/year/per

kid and $2.4 billion per kid per lifetime.

If pediatric neurology has given up, and the government has to take over,

then the government--both state and federal--still has a responsibility to

ensure their constituents that public monies are utilized as wisely as

possible--no matter what any special interest group (pediatric neurologists

neurologists) has to say about it.

To further help, you might want some graphic examples of the efficacy of

Hyperbaric Oxygen Therapy. I have uploaded 2 before/after examples pulled

from the downloadable video from Neubauer's website:

You can download these from the photo section of this listserv. I have

stacked these two examples to create a letterhead that I frequently use.

Once people see the effect of HBOT for themselves--particularly lay people,

it becomes very difficult to argue with.
