Guest guest Posted February 27, 2003 Report Share Posted February 27, 2003 Smoking is not the issue, it is----rather ones work environment exposed them to a component greater than what anyone else that has asthma would have been exposed too and got the same disease, asthma. I had to read the article several times to make sense of their argument. That's the new argument from the Industrial Commission, they are winning cases by using this deploy. I do not need replies to this post, just FYI for those of you seeking a claim for occupational asthma. Guest guest Posted March 1, 2003 Report Share Posted March 1, 2003 Hey Janet and all, I finally got WISHA (OSHA here in Washington State) to come into inspect the workplace. Of course they are about 13 months too late. They were unable to find any damp wall areas behind some lockers, but then the director of maintenance had already drilled holes and obtained the samples before their arrival. My former Director sent three hand-picked staff to be interviewed by the inspector. The Union for some of the staff helped to mobilize this investigation. They will have other staff speak with the WISHA inspector and have promised that this will be confidential. Amazing that I complained for a year and got no help. The Union called and read the riot act to WISHA and they were in within 3 days. The Maintenance Director basically said that this mold issue was creating hysteria in the Department. I had been fighting to have the lockers removed and the area behind cleaned as this is where the water drained down from. Two separate consultants recommended doing this to gut out the walls where the Stachy was identified in the area bordering the lockers. Guest guest Posted March 1, 2003 Report Share Posted March 1, 2003 Janet, Read the message again.I stated that nothing was done until the Union for one of the groups at the hospital mobilized a few weeks ago.This was after there was a change in personnell.The prior union representative did not submit a complaint that a member had given her 6 months ago. Unfortunately,I was not a member of a Union as I was a manager when I worked there.The nurses Union only wrote letters to the hospital but did not do much to follow through.I had to give info to nurses who were in the Union and they would pass that on.The nurses Union would not speak with me directly. I have found a law firm to represent me but the only way I can fight this in Washington State is by contesting the denial of my claim by the private insurer for the hospital.I have to file through the state's L & I office.What a mess.
