Smoking is not the issue, it is----rather ones work environment exposed them to a component greater than what anyone else that has asthma would have been exposed too and got the same disease, asthma. I had to read the article several times to make sense of their argument. That's the new argument from the Industrial Commission, they are winning cases by using this deploy. I do not need replies to this post, just FYI for those of you seeking a claim for occupational asthma. THis is being used for those who have been expose to mold too, as it was just used in my case, trust me it is happening.

Anyone who smokes or smoked 1 pack of cigarettes a day and says they got asthma from somewhere else should really think about suing or asking compensation from employer. They will try and find every reason to deny you anything with this reason. More appropriate would be "agravation' of what you might already have.........big risk because of what we all know smoking does. It is a double sworded knife. Hey Janet and all,

I finally got WISHA (OSHA here in Washington State) to come into inspect the

workplace. Of course they are about 13 months too late. They were unable to

find any damp wall areas behind some lockers, but then the director of

maintenance had already drilled holes and obtained the samples before their

arrival. My former Director sent three hand-picked staff to be interviewed by

the inspector.

The Union for some of the staff helped to mobilize this investigation. They

will have other staff speak with the WISHA inspector and have promised that

this will be confidential.

Amazing that I complained for a year and got no help. The Union called and

read the riot act to WISHA and they were in within 3 days. The Maintenance

Director basically said that this mold issue was creating hysteria in the

Department.

I had been fighting to have the lockers removed and the area behind cleaned

as this is where the water drained down from. Two separate consultants

recommended doing this to gut out the walls where the Stachy was identified

in the area bordering the lockers. The administration has been fighting tooth

and nail to avoid doing this.

Am I reading this right? They are still keeping it quiet? Even uunon? Same with me.OSHA wont even talk to me about my "alleged complaint" that is all fixed.NOT!!!!!!!! PleASE LET ME KNOW IF i AM READING RIGHT. iTS EARLY IN THE AM. ps my OWN Union is against me now.

I have to say I find new information today interesting. When I had to deal with Traci in HRO , I started to refuse to go there as the back stairwell almost sent me to ER with asthma attack.

So I complained and wasnt met with much sympathy.

TODAY, I hear this stairwell is cloesed off DUE TO TOXIC MOLD!!!! But no one wants to help me prove to the government that I am sick from that toxic dump of a basement!

Whats up here, guys? Any help?

I still have heard nothing. Mr. Morin, are you going to get back to me about a civilian being able to ask for a Congressional Investigation?

I have forwarded emails to and from the Portsmouth Naval Shipyard, so you are all aware of my situation and the UNETHICAL behavior going on here. I am going to ask my attorney about contacting the Office of Special Counsel. There are wrongdoings. The Environmental Report was not addressed because of budget fiscal year ending? So I got sicker. Abuse of authority from my immediate supervisor Mari Shults, even my own union 2nd vice president. There were lies after lies sent to Senator Snowe from my own Human resource agency as well as to OWCP. OWCP threatens me with my life so I will give up. I even have more letters stating I could die from this skin testing from an Environmental Dr.,an ENT, a Pschychiatrist and there will be one from my attorney.

I have asked over and over again for help with ALL of this. I do not know where to turn as I am being forced out on disability. If there is help going on from any of you or a Congressional Investigation going on that I don't know about, thank you but please let me know. Mr. Morin had told me three weeks ago that he would get back to me on that. I will go public also in newspaper again. This is so unfair and I don't want to be mean. I did my job and did it well, and then got sick from that basement I sent you all pictures of. Then ALL broke loose and things have happened as lies and cover ups and threats that I never in my life would have believed. All I wanted was help to get better. Dear Congressman , Senator , Senator Snowe and Advisor Mr. Morin:

I feel that this has gone on long enough. Is it wrong for me to ask help from senators? Everything is hidden, I get forced off the rolls and cant afford the help I need. No one will know that the report that I have states EVERYTHING in that basement and it will stay covered. The government uses this stuff for bio warfare. My God, since when is it OK to sacrifice helping someone to lie and cover up and OWCP threats to do something that puts my health in dire jeopardy!

I have been sending to you all the emails to work at the Portsmouth Naval Shipyard. You all know what is going on now.

Mr. Morin, I have not heard back from you on my request of a Congressional Investigation. Please dont tell me you did an inquiry and I should get tortured with skin tests again in a dirty moldy clinic OWCP is paying for.

I dont know what to do. I am a sick single mother and am appalled after all the help I ask that nothing has been done. The Shipyard wants me to shut up and get off the rolls onto disability. I could have worked at home, but have been refused. I am an intelligent woman. So please do not think that I do not realize what they (The Shipyard) is doing to me by biding their time until disability is accepted and not answer me.

I am asking sincerely for help. This has gone on long enough. I do not know where else to go for help but will try I guess. My life depends on it.

Read the message again.I stated that nothing was done until the Union for one of the groups at the hospital mobilized a few weeks ago.This was after there was a change in personnell.The prior union representative did not submit a complaint that a member had given her 6 months ago.

Unfortunately,I was not a member of a Union as I was a manager when I worked there.The nurses Union only wrote letters to the hospital but did not do much to follow through.I had to give info to nurses who were in the Union and they would pass that on.The nurses Union would not speak with me directly.

I have found a law firm to represent me but the only way I can fight this in Washington State is by contesting the denial of my claim by the private insurer for the hospital.I have to file through the state's L & I office.What a mess.
