The Sheriff couldn't serve us either because I was in Pennsylvania, West Virginia, Virginia and Tennessee on 12/16 and on a bus from Lawton, OK to Barnstable from midnight of 12/12 until 8:30 am 12/15. I am not saying you abandoned your property; but they is another ploy which is being used to put the responsibility on the property owner. They really know how to put the sqeeze on canceling homstead, raising property values, and pushing the property taxes and insurance preimums out of the roof. More people have been killed over misunderstandings of women, hunting dogs, and property lines. I firmly belive in letting our peers know where mine begins and thiers ends. My understanding is it is very easy to serve process to an individual or a former address. The only way I know how to respond to such threats, is be prepared and be laying in waiting. Not many attorneys real understand how to get the upper hand, but the insurance industry are ole pros. If you can get the goods and they feel the noose tightening up; they become more willing to deal as that long lost freind. Whats another half million dollars; they blow that on a superbowl weekend. You may need a plan which may translate to cutting losses. But we should all know that now when we invest in insurance these days. Its a very one sided poker game with a buch of cheats standing aound the back of the table to make sure we don't cheat, but also to see if they can see the cards your dealt. I think this should be in Federal court in Oklahoma. Let the Massachusetts folks that we name have to come to me. When we charge a few dozen people, each will have to get their own lawyer. Imagine a few dozen lawyers and the confusion. This is what I'm sending out to lawyers along with our story of the corruption by town and state. January 29, 2003 We need help! We had to leave our home, in Massachusetts, due to Toxic Mold and the illnesses we were suffering from it. While we did leave our home we did not desert or abandon it. We left our furniture, clothes, food, family photos and a car there. We also left the phone, electricity and water on and had our homeowners insurance. We notified the post office to forward our mail, and provided an address, until the end of the year. I intended to return once I had my family in safe housing. It took me several weeks to return due to our illnesses. We stayed with friends in Lawton, Oklahoma. I did return on December 15, 2002, after traveling by bus from Lawton to Cape Cod from December 12 to December 15. I arrived at 8:30 AM on December 15. When I got to our home, I discovered we had been robbed. I called my Wife in Oklahoma and did a quick inventory of what was missing. The items totaled over 8 thousand dollars. I also noticed that some of our trees that we had bought and brought in had been taken and the back yard was ripped up. When we left on October 28, 2002, all windows and doors were locked and the lights were turned off. I checked everything before I went out through the garage door using the garage door opener. On December 15, 2002, some lights were on and the front metal and screen doors were unlocked. I became ill and could not stay so I got in my car and drove straight back to Oklahoma arriving on December 17, 2002 at 4:45 AM. There was a snow storm coming, they were predicting a blizzard, and I didn't want to get snowed in. After arriving back in Oklahoma on December 17, 2002, I contacted the Barnstable Massachusetts Police and filed a breaking and entering and theft complaint. The police sent an officer to our 38 Hawser Bend Centerville Massachusetts home. The officer stated that our home had been sold at auction by the bank and new owners had replaced the septic system. Strange, we never had any septic system problems. I then contacted the Town Assessors and the Registry of Deeds and was told that our home been sold on December 16, 2002. I got the name of the new owner and their attorney from the county records and wrote to them. I told them of the story and history of our home just in case our bank had never told them. Neither the new owner or their lawyers ever responded to me. Our insurance adjuster called me a day ago after talking with the new owner. Seems they think they bought our furniture, clothes, food, family pictures and appliances. They are renting out the house and using our belongings. Our home is a large family size home so I would guess that children will be in the house. The Toxic Mold in our home, according to National experts, Doctors and our insurance company, is a health and safety danger. That is why we left. The Toxic Mold is a direct result of illegal and substandard construction the town knowing allowed and the State of Massachusetts partly performed. This is stated by our insurance company and other experts. The new owners did not have time to " fix " the Toxic Mold from December 16 till the present time because to fix it the house had to be torn down. Building experts stated it would take 6 months to a year to do this. I doubt if the new owner has told anybody so they are in violation of state and federal laws when renting a home that must be condemned and torn down. The bank knew it. According to Barnstable County Registry records that were discovered yesterday, the banks, their lawyers, the town and new owners' state we were served with eviction and entry papers. This is usually stated under oath and penalty of perjury. We were never served or notified in any way! This would constitute perjury, fraud, obstruction of justice, conspiracy, breaking and entering, civil rights and theft and many other violations of Federal Laws. I wonder who let the new homeowners and their inspectors into our home before they bought it? Did the town send inspectors for the new buyers after they refused to send building and health inspectors when we asked for the building defects and Toxic Mold? Somebody had to inspect the septic system and that means getting into the house. We have problems with the home being foreclosed and auctioned because we were swindled by the town, builders and bank when we bought the house. Suffice it to say that the banks and realtors had insider information of the house issues before we bought it and never disclosed those facts. Under the Law we still have rights and the town, banks and their lawyers broke the law and violated and denied us our rights. The bank refuses to talk to our insurance company about the break-in and theft. The bank regularly contacted us by mail trying to find a way to not foreclose or go to auction. We told them many times in writing of all of the construction, Toxic Mold and zero value as soon as we knew of it. They know of the construction issues, house collapsing, for about six years. We asked them to work with us and they refused. As late as early December, they mentioned that if they sold our home would we work with them (accept money) to forgo eviction proceedings. They didn't want the cost or publicity. They said they might give us a few months rent for a comparable sized home and would get a local realtor involved, no realtors contacted us. I again restated the illegal construction and dangerous Toxic Mold issues and they never replied. The Town also collected over 40 thousand dollars in property taxes on our home when they knew it had a zero value. Their own records state the home had construction defects. This is fraud and under the Law they can, and must, be made to give us back the property tax money. Also, in a Barnstable Police investigation, the town inspector admitted he knew the home had many building code violations while it was being built. He was never charged. The police investigation was for attempted extortion from my Wife. The DA would not prosecute because he said my Wife was only a homemaker without credibility compared to a male town employee. So, after all of the written communications with the bank and their lawyers, I find it ironic that they would lie and steal from us. Lying under oath is perjury. The bank needs to be fined by regulators. Most importantly, our rights need to be given back to us. We need legal representation to file charges against all those involved. After reading our following story, you will see there are many names to be included in a lawsuit. I've been told we can file here in Oklahoma or Texas in Federal Court which will make those who violated us have to do business here. Will you helping us or do you know somebody that can?
