Tom,

The purpose of the listserv is to access HBOT

reimbursement via Medicaid, thus " . "

We're not really here to debate the merits or demerits of Oxyhealth

or your vendetta against Samir Patel, the president of Oxyhealth.

As I have expressed to you countless times in the past, your

perpetual tirades against Oxyhealth--under a guise of " safety

concerns " are quite tiresome--especially when you refuse to even

acknowledge or discuss the very real criminal act of Performance

Hyperbarics, in direct and clear violation of FDA regs, selling

modification kits to untrained, non-CHT parents so they can increase

chamber pressure from 1.3 ATA to 1.5 ATA in a pressure chamber that

is not ASME-PVHO tested or approved to go to those pressures.

You've accused members of this group of having ulterior motives.

You've stated they do not provide " full disclosure, " while you claim

employment with " American Hyperbarics " and claim membership and

officer status in the " American Association for Hyperbaric

Awareness " --while you actually live and work--in Canada.

What have you done to help American parents paying American tax

dollars into the US Govt treasury, what have you done to help

American parents access HBOT as guaranteed 40+ years ago with the

creation of EPSDT?

That's what we're trying to do here Tom, because the Undersea and

Hyperbaric Medical Society has instituted a ban on HBOT for brain-

injury for some 35+ years, as documented here http://

www.oxyhealth.com/images/noncovered.pdf .

Tom, how long have you been a member of the Undersea and Hyperbaric

Medical Society?

Tom, what steps have you taken to persuade the UHMS to expand its

indications list to include brain-injury?

Specifically Tom, how many times have you attempted to expand the

UHMS indications list to include HBOT for cerebral palsy, autism,

stroke, multiple sclerosis, and TBI?

Tom, how many members of your precious ASME-PVHO committee are also

members of the Undersea and Hyperbaric Medical Society--of which

you're also a member?

Tom, because of this situation created by your Undersea and

Hyperbaric Medical Society, parents being parents have had to do what

they've had to do by getting their children into the only available

device--by economics and by geography--where they could increase

atmospheric pressure, which happens to be an Oxyhealth chamber, and

all you've done is try to banish Oxyhealth and thus banish the only

available HBOT for these children.

Tom, don't you drive around with a truck full of hyperbaric chambers

and provide HBOT? Have the sale and availability of Oxyhealth

chambers hurt your business?

Don't you also own and/or manage a freestanding hyperbaric clinic in

Canada?

Tom, a Canadian member has posted here that you have managed to

somehow persuade the Canadian government to ban the importation and

sale of Oxyhealth chambers in Canada. If the sale of Oxyhealth

chambers was suddenly allowed, how would that impact the level of

business at your Canadian clinic?

Boy these are a lot of pointed questions. It makes people wonder if

you yourself have an ulterior motive and it makes people think you

have not provided full disclosure to the membership.

This creates doubt about your character and your integrity. Your good

name may not be so good after all.

It's about to get worse Tom.

You're now on a moderated status on the listserv, and

you will not be allowed to answer or respond to any of the questions

I've asked. You will not be allowed to explain yourself until you

first make a full, formal email complaint to Christy Foreman of the

FDA about Performance Hyperbarics and their practice of selling

modification kits. Your complaint must be full of tomfoxknown

citations of FDA and ASME-PVHO regulations. You need to proofread it

so that it makes sense instead of nonsense. If you're having trouble,

ask your wife to help you. She has a lot of good sense.

Remember Tom, you're Mr. Safety. Give Christy an earful. Lay the law

down on her. Tell her that the kits are being sold by a guy named

Charlie of ANDI and he was the official representative of

Performance Hyperbarics at whatever autism conference that was in

Atlanta--which means these aren't two separate businesses but one.

Just make sure it's " cc:'d " to the listserv. Here's

our email address: medicaid

Here's Christy Foreman's email address: christy.foreman@...

You're so concerned about safety, it's time for you to put up or shut

up.

Remember, your reputation is at stake.

However, like everything else in the United States of America, it's

your choice.
