Guest guest Posted September 23, 2008 Report Share Posted September 23, 2008 Last Spring all Georgia parents of disabled children rightfully celebrated the legal victory in v Medows, wherein the Georgia Department of Community Health (DCH) sought to reduce physician prescribed nursing hours from 94 hours per week to 84 hours per week. The Federal Court of the Northern District of Georgia ruled DCH must provide 94 hours because the child's physician had decided 94 hours were " necessary to correct or ameliorate " Callie 's condition. In other words, v Medows ruled that whatever a treating physician prescribes is what Georgia Medicaid must provide. Alas, the barbarians at DCH have appealed v Medows to the US 11th Circuit Court, one step below the United States Supreme Court.
