You, the citizens of Massachusetts, have a unique opportunity to reform part of their Government and take back some of the rights that the Legislature has usurped from us. By using our Legislative and voting power we can force the Legislature to make these changes.

I have written and submitted five different pieces of Legislation on behalf of the citizens of Massachusetts. I have honored my Son, Kenny, by using his name in each. He is handicapped, retarded and a quadriplegic.

I have included my reasoning and my submissions. Due to the length of SD2068, SD2069 and SD2070, I have not included the full text. If somebody is interested in reading the complete text they can contact me by e-mail or mail and I will send them.

If you support any of the pieces of Legislation contact your State Senator and Representative and tell them you want it passed immediately. You can also choose to send your letter of support to me and I will forward it to your elected representatives on Beacon Hill.

Public Records

Under current Massachusetts Law, the people are not allowed any access to the documents or Public records of the Legislature or Judiciary. In an open and free society, the People have a right to know. My Law will open those records to the citizens.

SD2066 -

AN ACT RELATIVE TO PUBLIC RECORDS:

SECTION 1. Section 18 of chapter 66 of the General Laws, as appearing in the 2000 Official Edition, is hereby amended by striking out the words "This chapter shall not apply to records of the general court, nor shall" in lines 1 and 2 and inserting in place thereof the following: - This chapter shall apply to records of the general court and the judiciary, provide, however,.

Personal Care Attendants

Under current Massachusetts Law, if a parent or guardian of a multiply handicapped and/or retarded child or adult requires the help of a Personal Care Attendant under Medicaid or other state medical coverage so that they can care for their child/adult at home rather than in an expensive institution, they are discriminated against. The are forced by State Law to hire somebody that is unknown to them. In many Massachusetts documented cases, some of these aides have police or criminal records. Many cause injuries to the child/adult or the parent.

My Legislation will allow parents to be paid for the same services a stranger can be currently paid for. This will also allow many parents to become wage earners and taxpayers. Many are unable to collect Social Security because they "worked" as unpaid professionals for their children for many years.

This is about dignity and quality care. It also saves the State millions of dollars each year when parents care for their children at home rather than the State having to at Institutions and Hospitals.

SD2067 -

130 CMR 422.411, as appearing in the latest official edition, is hereby amended by striking out (a), ( and © of 411 (A) (1) and inserting in place thereof the following

(a) A family member, as defined in 130 CMR 422.402;

Tort Reform

Under current Massachusetts Law, if a local or state government building inspector disobeys or refuses to enforce Building, Fire, Health and Safety Codes they cannot be held liable or accountable by the citizens they have harmed. These "protection" Laws are Un-Constitutional in that they deny Citizens their Rights to Due Process.

My Legislation will hold only those that have broken state laws accountable. It will also hold those local and state government entities that have known of, profited from or protected those inspectors that have broken the law and placed citizens in danger legally liable and accountable.

Tort Reform Legislation

SD2068 -

Section 10 of Chapter 258 of the General Laws, as appearing in the latest official edition, is hereby amended by striking out Sections E and F and inserting in place thereof the following -

Construction Lemon Law

Currently under Massachusetts Laws, many are allowed to withhold information in relation to construction or the prior history in the sale of property and real estate. It means the buyer, consumer and citizen is almost defenseless to unscrupulous agents. My Law will allow citizens to bring Legal action against any that have practiced deception, fraud or other dangerous acts against a citizen or group.

By restoring these Legal rights to citizens it will demonstrate to those, that practice deception, that they will not be protected. This will apply to builders, banks, lawyers and private and government inspectors. Nobody will be above the Law.

SD2069 -

AN ACT TO PROVIDE FOR ENFORCEMENT OF LOCAL AND STATE BUILDING, FIRE, HEALTH, SAFETY, ELECTRICAL AND BUILDING CONSTRUCTION LAWS AND STANDARDS AND FOR DISCLOSURE.

Toxic Mold Law

As we see the increase of Toxic Mold in our homes, schools and places of work, action must be taken to protect the citizens. Those that become ill from these Toxic Molds need help. Those that knowingly allow and/or create the conditions for Toxic Mold must also be held accountable under the Law.

SD2070 -

AN ACT TO ENHANCE THE EFFECTS OF REGULATIONS AND LAWS AIMED AT THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY IN REGARDS TO TOXIC MOLD.
