Guest guest Posted December 10, 2003 Report Share Posted December 10, 2003 You need to find a lawyer with a belief in the adverse effects of mold on health, and familiar with real estate law. Most states now require sellers to disclose known problems with houses they are selling. If a neighbor knew of the problem, the seller almost certainly did also. If nothing else, because of failure to disclose a known health hazard, you might at least be able to rescind the sale and avoid the stigma of foreclosure against you. With luck you might find a neighbor who had been told by the seller that they were moving due to the mold problem, and willing to testify to that effect in court. Family and I were exposed to molds that made us ill - stachybotrys, aspergillus, penicillium, alternaria, and cladiosporum, in our newly purchased home. We bought it last year from a previous owner who knew about the mold, but didn't disclose it to us - the neighbor did after we moved in! The house is only 6 years old, but we've now discovered that structrual defects have allowed the moisture in and mold spores are everywhere. The insurance claims it's pre-existing. WE've been living outside of the home for 11 months paying both mortgage and rent. We get ill from what we can not see! We have coughed up blood, nose bleeds, vomitting,dizzines, hairloss, memory loss, skin rashes, swelling of soft tissues, severe headaches, fatigue...etc. We are looking at foreclosure because we can't afford both mortgage and rent. Any advice, suggestions? Please write back - we have been very alone in all of this. We moved into the home in October of last year, and moved out only days after Christmas. As of this Christmas we will have been without a permanent residence for almost an entire year. We have two boys and a small dog. WE live in central FLorida. Can't find any help anywhere. Thank you.
