Hi everyone,

I wanted to give you a warning. I have been ripped off in the past

by The Chemically Sensitive Living Store. Luckily I fought back

with my credit card company and got the money back. I guess others

have NOT been so lucky. I rec'd this email memo below. I wanted to

let you all know that I have been contacted to legally take them OFF

my site. I will have a memo on it with a link that goes no where.

Pass the word on to your friends to keep them from getting ripped

off too!

This is a legal request to remove the company Chemically Sensitive

Living from your reference directory. Multiple complaints have been

filed against this company and many people have already been

injured. Thank you for your help.

Buyer Beware: Consumer Alert

Buyer Beware: Chemically Sensitive Living and Crown City Mattress

Formal Complaints filed with FTC, Attorney General, Better Business

Bureau

If you are buying an organic mattress, organic bedding, organic baby

products, organic sheets and pillows or other items you may have

more to worry about then just the items being organic. Chemically

Sensitive Living has had formal complaints filed against them for

consumer fraud and violation of FTC’s Mail or Telephone Order

Merchandise Trade Regulation Rule. There have also been several

complaints against Gail Restivo’s Chemically Sensitive Living

filed with the Better Business Bureau.

One consumer complained that Chemically Sensitive Living attempted

to keep 100% of their funds without delivering the products. After

failing to deliver over $2500 worth of items in the way and manner

described during the order, the consumer started suspecting that

there was something suspicious about the company and canceled the

order. Chemically Sensitive Living’s owner Gail L Sullivan -

Restivo then attempted to keep 100% of the consumers funds by

claiming a 60% “restocking fee†and a 40% store credit fee.

Effectively trying to take 100% of the consumers funds without

delivering the products. The Attorney General’s office stated that

since Mrs. Restivo never mentioned any such “store policyâ€

during the phone order she can not legally make any claims on the

funds and is required by law to return the money. Additionally, the

FTC said Mrs. Restivo is in violation of the FTC’s mail and

telephone order merchandise trade regulation rule which requires a

company to deliver the items in the time frame promised or they are

required to immediately refund all funds to the consumer. This rule

also applies to all internet sales.

The consumer was originally looking specifically for a Crown City

Mattress and was directed to Chemically Sensitive Living for the

purchase. When Crown City Mattress was informed of the problems with

Chemically Sensitive Living the owner of Crown City Mattress replied

that he was not interested in the treatment of the end consumer. He

said that Chemically Sensitive Living was the distributor and the

one who made his company the most money. He said although he may not

agree with his clients politics he cared only about the money

Chemically Sensitive Living could bring in and didn’t really care

about the buyer or their treatment.

If you are having difficulty with a company it is a good idea to

alert the public by filing complaints with the appropriate

authorities including the FTC, BBB and Attorney General. The

complaints will be kept on file and may eventually be merged with

other cases to bring criminal charges against the company.

Consider paying with a credit card instead of a personal check. If

the company fails to deliver the items the credit card company may

help by reversing the charges.
