Guest guest Posted January 20, 2011 Report Share Posted January 20, 2011 Dear all, I received word from our attorney that the judge who heard our case in Superior Court on Dec. 15,2010 has ruled favorably for our three autistic children to receive HBOT under the EPSDT statute. The state has 30 days from the signed order date to appeal to the state's Court of Appeals. This would be their highest appeal option. So far, we have won in Superior Court in the fall of 2009, and the state reimbursed us for the costs we had incurred to use HBOT for two of the children. Then, the Administrative Court ruled favorably in July, 2010 to have another round of treatment covered for all three of them at the prescription and request of our pediatric neurologist. The state didn't like that decision, and so our case was heard in Superior Court in December. The Superior Court judge has agreed with the ALJ, so we will wait to see if the state appeals one last time or if they decide to cover the treatments now.
