Folks, please don't give legal advice unless you know what you're talking about--unless you have personally researched the law and confirmed the assertions you are making! People--including you--can get into a LOT of trouble from that! The laws vary from state to state, so it's critical to find out what YOUR state law is, the requirements and the exemptions (you can usually get this information form local health departments or their websites; free law sites may not have current law). Some states require Hep B in the hospital before the baby leaves the hospital. Here in NC (last time I looked), you had 3 months to get the first Hep B vaccine, but hospital staff have threatened to call CPS when a parent objects to the Hep B vaccine, because *they* don't know the law--so find out the law in your state, and have a copy of it--requirements and exemptions. It's critical, with hospital births, to investigate the law and exemption rights ahead of time, and to have a written plan that's a part of the birth plan ahead of time, so that everyone concerned knows ahead of time that *this* baby isn't to be vaccinated, and that there's a legal exemption right supporting that part of the plan. Otherwise, there's a good chance the the baby will be vaccinated, because that's the routine thing to do. The only cases that are tricky are those moms who show antibodies for Hep B before delivery and then baby is required to get hep b vax (few and far between) and many have gotten around that. I am not an attorney but have been working in the area of vaccine dangers since the early 80s and especially since 1995. I have worked with thousands and thousands of parents over the years and KNOW that in every case they can and have refused hep b vaccine at birth in every state.
