Guest guest Posted March 29, 2011 Report Share Posted March 29, 2011  what state do you live in? check on line for your state's exemption on being vaccinated. every state has an exemption. but you must claim it in the prescribed manner. people get in trouble by not following their state's exemption law/claim when they tell the school they are not going to have their child vaccinated. that will get you a head to head confrontation with some possible threats from the school powers. however, if you do as the legal exemption shows you, once you follow 'their' rules for exemption it ends all arguments and threats. so get on line for your state and search for the vaccine exemption. in fact, for my state I emailed my local state assembly person and asked them for help in locating my state's statute that allowed exemptions from vaccines. she gladly helped me and now i have that information for use my grandson when he enters school so he can be exempt. good luck. If by chance your state does not allow a "religious" exemption but you were to claim it, that will not work and they will force you to be vaccinated. However if you use the legal jargon they will be under the constraints of the Law and you can be exempt. You have to be very proactive and savvy and be willing to do the work to write up your statements for the local governments of your school district. The following is information directly from the " vaccine exemption Utah " google search which I did - and provides quite a lot of information about exemptions in Utah, including that you have access to medical, religious, AND philosophical exemptions - And that the philosophical exemption needs to be signed only by a health department witness (they will not usually try to argue with you, according to my experience. They will just sigh and sign) (we have always had ours notarized). Here is the quote from the site: " Submit a statement that the person has a personal belief opposed to immunizations, which is signed by a parent and witnessed by the local health officer or his designee; or a statement that the person is a bona fide member of a specified, recognized religious organization whose teachings are contrary to immunizations, signed by a parent. The form for exemption is provided by the Department of Health. " I've done both of these in NY state. As long as you provide the data to support you religious exempt, i.e., a bona fide organization, the religious exempt is straightforward (I won't say a breeze, but very straightforward). I highly recommend taking the philosophical whenever it is available. It has never been available to us; however, we've exempted our children in the following states: CA, VA, NY, MA over the last 24 years. We have expressed ourselves in repressive environments for a long time before there was nearly as much support AND recognition of the rights of those claiming " immunological freedom, " as there is today and have found that we've always been able to be successful in keeping our children's bodies clear of these poisons. My advice to everyone is always to take the simplest route: CIRCUMVENT whenever you can. Maintain a clean low profile. You have to be very proactive and savvy and be willing to do the work to write up your statements for the local governments of your school district. The following is information directly from the " vaccine exemption Utah " google search which I did - and provides quite a lot of information about exemptions in Utah, including that you have access to medical, religious, AND philosophical exemptions - And that the philosophical exemption needs to be signed only by a health department witness (they will not usually try to argue with you, according to my experience. They will just sigh and sign) (we have always had ours notarized). Here is the quote from the site: " Submit a statement that the person has a personal belief opposed to immunizations, which is signed by a parent and witnessed by the local health officer or his designee; or a statement that the person is a bona fide member of a specified, recognized religious organization whose teachings are contrary to immunizations, signed by a parent. The form for exemption is provided by the Department of Health. " I've done both of these in NY state. As long as you provide the data to support you religious exempt, i.e., a bona fide organization, the religious exempt is straightforward (I won't say a breeze, but very straightforward). I highly recommend taking the philosophical whenever it is available. It has never been available to us; however, we've exempted our children in the following states: CA, VA, NY, MA over the last 24 years. We have expressed ourselves in repressive environments for a long time before there was nearly as much support AND recognition of the rights of those claiming " immunological freedom, " as there is today and have found that we've always been able to be successful in keeping our children's bodies clear of these poisons. My advice to everyone is always to take the simplest route: CIRCUMVENT whenever you can. Maintain a clean low profile. This is a well-educated and well-meaning group, but law is a specialized arena, and misunderstandings about vaccine rights are common (be leery of advice on anti-vaccine websites for the same reason--people have lost rights relying on it). The main thing to do is to be sure that whatever option you chose is a legal one. For example, in many states, doing alternate vaccines schedules may not be legal option, even though some doctors will support them. Look carefully at the wording of your state's laws. Often, the law requires only one parent to claim an exemption for a child to be exempt. If the other parent doesn't know that, though, s/he may vaccinate the child against the exempting-parent's wishes. Where parents disagree about vaccinating the children in custody disputes, the pro-exemption parent may have a significant advantage if there are religious objections involved. However, that issue often has a multi-faceted analysis that depends on several different things. The truth is, vaccine rights are complicated. Individual's rights depend on the specific facts in each situation, their physical location (state and fed jurisdictions), and the specific context (school, immigration, military, healthcare employees, etc.) Bottom line, if it's a legal issue that's really important, it's worth consulting a knowledgeable attorney--these matters can be difficult or impossible to fix retrospectively. You wouldn't go to a hairdresser to get your car's engine rebuilt, and as much as I love and respect everyone on this list (really, I do!), they aren't the right folks to ask for legal advice. If by chance your state does not allow a " religious " exemption but you were to claim it, that will not work and they will force you to be vaccinated. However if you use the legal jargon they will be under the constraints of the Law and you can be exempt.
