Judge tells state to release anne Godboldo's daughter as official defends CPS action

anne Godboldo is not going to be reunited with her teenage daughter anytime soon, but a judge on Monday told the state to release the girl from a Northville mental health facility into the custody of her relatives.

May 5, Detroit Free Press: A Wayne County juvenile court judge ruled Wednesday that a girl -- taken by the Department of Human Services from her mother, who is accused of medical neglect -- needs to be placed with a relative by Friday afternoon.If the 13-year-old isn't placed by then, Judge Lynne Pierce ruled she'll have a hearing at 1:30 p.m. that day and hold any party not cooperating with the placement process in contempt of court.Godboldo reportedly fired a gun -- not at officers, her attorney claims -- during a standoff when Child Protective Services and the Detroit Police Department attempted to remove the girl from her Detroit home in March.According to her attorney, Godboldo upset CPS when she took her daughter off prescribed anti-psychotic medication in lieu of a holistic treatment recommended by a personal physician. She said the original prescription only exacerbated the girls medical problems.Parental rights advocates around the nation have backed Godboldo's cause, saying the case is indicative of the state's general refusal to recognize alternative treatment options. But Maura Corrigan, director of Michigan's Department of Human services, says there's more to the story."You could say that there is an abstract debate about holistic medicine versus what a traditional doctor would say, but that is going to be a very considered decision by a judge about whether there is evidence," Corrigan told host Beckmann this morning on WJR-AM 760.While she declined to discuss specifics of the case, Corrigan said CPS did not unilaterally decide to remove the girl from Godboldo's custody."Before you would do something so serious, as to take a child away from its parents, you need a judge -- a neutral and detached judge -- to decide whether you've got enough evidence to do that."Meanwhile, Godboldo's daughter has spent the past several weeks in state custody despite testimony from authorities that she has been fine without medication and is not in need of immediate treatment."The Department of Human Services have put up one obstacle after another," family attorney Wanda said Wednesday, per WDIV. "They are asking for unrealistic things that no one ever had to provide. The medical doctors have submitted a treatment plan."
