Judge Says Teen Can Be Released To Family

DETROIT -- A family court judge said Wednesday that a 13-year-old girl at the center of a custody fight between her mother and the state could be released to her family by Friday.

ann Godboldo challenged police in late March when they went her west side home with a writ to take her daughter, Ariana, out of her custody and was arrested.

According to the Department of Human Services, there were claims of neglect against Godboldo for not giving her daughter prescribed medications. Godboldo has said the anti-psychotic medications prescribed for her daughter would do more harm than good and refuses to administer them.

The teen has been in a state facility, the Hawthorne Center, during the custody hearings. But Wayne County Juvenile Court Judge Lynne Pierce said DHS representatives and family members must come to an agreement on a treatment plan for the teen. Pierce said she wants to stop the "stonewalling" between the two sides. DHS representatives told the court the family's treatment plans were vague and not complete.

"The Department of Human Services have put up one obstacle after another," the family's attorney, Wanda said. "They are asking for unrealistic things that no one ever had to provide. The medical doctors have submitted a treatment plan."

said DHS has to understand that there are things in the treatment plan that cannot be evaluated until the teen is returned home.

"The more that she is in Hawthorne Medical Center, mentally it is deteriorating her," said the teen's father, Mubarak Hakim. "She is getting bored, upset. She needs to come out of there as soon as possible."

The teen's aunt, Penny Godboldo, said she would be taking her in.
