He did get a new one right away, BUT he didn't automatically get the full benefits. We're on " probation " till Sept. 1st which is when our insurance is finally kicking in. UNFORTUNATELY....I've got a 3 month lapse. SO I did what I've suggested to everyone who has a problem getting their Xolair. I called SPOC. Told thm of my situation and that I'm a Patient Speaker. They blew me off!!!!!!! I am SOOOOOOO disappointed with them. Ok, I know it is summer and a lot of people are on vacation, but there has to be someone there who can help me out!!!! I'm so afraid that Blue Cross Blue Shield are going to say... " sorry..you've got a 3 month gap in your insurance, this is a pre-existing condition. " I wonder if I should call Vera at Genentec or Matt from Novartist and say... " you've got a National Speaker here who might not be able to get her meds. Usually this falls under the Cobra plan..the amt they have to pay is quite a bit more than their original premiums. But in the USA this is federally mandated that this is offered! For us it was $1500 per month.You fill out the paperwork and submit it to the " former employer " . " Former employer is supposed to inform the insurance company that the insurance is supposed to be coded COBRA. Monthly payments went to the " former employer " and guess what the former employer DIDN'T DO. (even though they cashed our COBRA checks-it says COBRA right on the canceled check, so they couldn't have missed it!). My husband reminded me the other day that often it is " planned incompetence " on the part of the business because they are so greedy! Let us know how this turns out. That's a lot of money to have put out for insurance for the company to have just " swallowed! " I came across this when I worked parttime in a private school accounting office and then my sister dealt with it when she left a law firm and had to be hospitalized before her new insurance kicked in. Glad the law firm was actually honest this time! It meant the difference in whether or not she got the treatment she really needed. Hope things begin to work out for you...... Keep extremely good records of everything - the check, notes of phone conversations, forms you've filled out, etc. I have gone to the Attorney General of my state when I've run into fraud. The words FRAUD and DECEPTION have a tendency to grab them. Look on the internet for the address for your state and write IMMEDIATELY including cancelled checks and other documentation. Here I have noticed that the attorney general is less likely to respond if I've gone to other officials, though. The other possibility is the State Insurance Board although here I've never gotten anywhere with them - seem to be in bed with the insurance companies themselves - a powerful lobby. Since this is a violation of federal law (HIPA), I would search that out on the internet right away, too. As a last resort (maybe first?) see an attorney.
