Dear All:

I had to respond to this post. DBPR in Florida is the biggest waste of tax dollars I have ever seen. That agency is supposed to not only license, but REGULATE construction, among many other areas. In almost five years of working as a consumer advocate I have yet to meet anyone who has filed a complaint with DBPR and had probable cause found in their case.

Florida Statute 489.129 lists numerous causes for discipline against a contractor. It includes misconduct, negligence, failure to obtain proper permits or inspections, etc... Under Florida Statue 455 all cases are "confidential" until 10 days after a finding of probable cause. I've seen a home where the exterior brick would moved when pushed, in one case the state sent its own structural engineers to a home and they determined that home would structurally fail in wind speeds of over 57mph. In Florida, that's a mere afternoon summer thunderstorm. And guess what? I've yet to see any case with a finding of probable cause.

The reason we have so many mold problems here is faulty construction due to moisture intrusion and the state allows this to continue. Florida will not discipline poor contractors, inspectors or building officials. Then to make it worse, they hide behind the confidentiality of Florida Statute 455 and none of the cases are public. Your builder may have hundreds of complaints, but you'll never find it out. Political contributions from the industry far outweigh the politicians concern for the welfare of citizens. In some state governmental agencies may help, but that is NOT the case in Florida.

I have only called them once for a friend. If your in Florida the number is, 800-375-6975. They may have the same agency in other states. I found this agency after alot of phone calls starting with the states Dept. of Health. Reinhart CMR/AMRT
