Apartment Residents File Suit Over Toxic Mold

People who live at a fairly new apartment complex near Research

Triangle Park are learning that toxic mold could be hiding inside

their building. Eyewitness News has learned about a lawsuit filed

against the colonial grand apartments just off page road by former

residents who are now having health problems.

Inside an apartment at the Colonial Grand was a couple who became

sicker every day. is an attorney for the and

Law Firm in Raleigh. She specializes in toxic mold litigation

and has just filed a lawsuit for two former residents of the colonial

grand apartments. " He and his fiance had become ill and she was

pregnant, " explains. " She had just been diagnosed with asthma. "

The couple lived there for four months and claim they suffered

serious health problems from alleged toxic mold growing in their

apartment. " We had independently confirmed that there are

unacceptable levels of various kinds growing in the apartment it was

in the air as well as in the wall cavities, " said .

Inspectors say the alleged mold was caused by a water leak, and

attorneys aren't certain if it was contained to one unit. The lawsuit

claims the couple tried to notify management but the problem was

never corrected. Eyewitness News has only learned of the one lawsuit

against Colonial Grande claiming toxic mold, but still some residents

say it's cause for alarm. " We're going pay attention more now but so

far we're fine, " said Ordaz.

Ordaz and his roommate Cantu play for the Durham Bulls and

live in the same complex with the pending lawsuit with the toxic mold

allegation, but they say so far they have no complaints. " It's

nothing but greatness, but it's the best place to live I think, "

Their apartment may be free of toxic mold, but attorney

says her clients weren't. She says they still have the health

problems to prove it.

A spokesperson for the Colonial Grand apartments says they are

investigating the allegations of toxic mold and if there is a problem

it will be corrected immediately. Residents have not been notified of

the pending lawsuit.
