Guest guest
Stacey, again...what a relief to find people who are willing and able to share so much information! You can help me tremendously right now...please tell me how your attorney held up your eviction. Can you fax or email me a copy of the complaint and other papers he filed? also please send me your court case file name and number so I can try to look it up online. My fax number is my main phone line, so I would have to know to turn on my fax software when you sent your papers. The evicition is still sitting in the court because my personal injury attorney has held it up by filing a counter claim law suit based on my case load. what did you mean when you said " based on my case load " ? do regular doctors diagnose mold poisoning? what is the procedure? is this the reason your eviction is held up? thanks so much... My story is exactly the same. I was wrongfully evicted after serving a non-compliance notice on my landlord to fix the proven problem with toxic mold in my apartment (I paid several thousands of dollars for a Certified Industrial Hygienist) to prove this was the reason why I thought I was dying and every person who came to my apartment experienced terrible lethargy. No kidding...everyone would end up falling asleep and when awakened would say...wow, i've never just fallen asleep like that...man, i'm tired. over and over. Me, my brother, and my son were all hit very hard with major health problems. And we were forced to leave and go to a hotel which i lived in for six months. The evicition is still sitting in the court because my personal injury attorney has held it up by filing a counter claim law suit based on my case load. I was then diagnosed with full blown mold poisoning and am now on medicaid and foodstamps also. Another option that is just now coming to mind is to call your local health/environmental agency - ours was the Sarasota County Health Department Environmental Division. They have a person that will come out to your place upon request and do an indoor air quality test and you can specifically request that they test for carbon monoxide, radon, and other harmful affluents which can all be caused by mycotoxins and molds. Little did I know, but this entity keeps reports on file for their tests and I found several for the complex I lived in. You also need pictures, documentations, and any other evidence you can accumulate, BUT speaking with a personal injury attorney first would be WISE and I suggest, your next move. There are certain things and certain steps that the attorney can advise you on so that you are properly protected. You can do a massive search on your area/county/state for mold related issues on the internet. I began by printing articles that pertained to my geographic loation and then started emailing and calling every attorney I could find tha had anything to do with mold. There are quite a few good ones in your area that I come across in my search. The whole process is a bloody nightmare, but one in which only worsens if you do not take appropriate action to protect yourself accordingly. I would have died in the apartment, trust me. Here are my news links. Try to listen to the videos if you can and you will get an idea of what I managed to go through when it first started... 11/02/03 – 11PM _Complex mum as mold drives tenants from apartments_ (http://www.wfts.com/stories/2003/11/031103mold.shtml) 11/03/03 – 6PM _Upscale complex ordered to clean mold out of partments_ (http://www.wfts.com/stories/2003/11/031103mold2.shtml) 11/04/03 – 6PM _Whistleblower tenant being evicted from upscale apartments_ (http://www.wfts.com/stories/2003/11/031104mold.shtml) Let me know if I can help further.
