Dear HADD leaders,

I was referred to you by Patilla DaHun of the discussion

group. Could you please tell me if you have any attorney or lay contacts in

NC? Moisture and mold in my home has ruined me financially, I am being

evicted from my own home with no family and no place to go, and I

desperately need advice. Does anyone know of caselaw regarding synthetic

stucco homes being " unsellable " , leading to foreclosure and loss of one's

equity? If so, please let me know, as this is what has happened to me. I

can do a lawsuit, but who do I sue? The builder is out of business and

moved to another state.

When my ex husband left my kids and me in 1995 I was given our new stucco

home as my part of the " marital estate " . As a homemaker, it was to be my

" nest egg " ...my only asset...which I could liquidate if need be. In 2001 I

won a $100,000 lawsuit against the builder for moisture and mold problems.

His insurance company, Zurich, disputed the decision and we appealed. The

case has been heard in the NC Court of Appeals, but I have not received a

decision yet. All my court pleadings and papers are online at

When I got into severe financial problems last year I tried to sell my house

to realize my equity. No one will even look at it because its synthetic

stucco. Real estate agents will stop in front of my house, call me on their

cell to say their client is interested, but " is it synthetic stucco? " . When

I tell them " yes " , they back off... fast. Many agents told me that their

client's employer (who was moving them to Charlotte) would not help their

employees finance a synthetic stucco home.

As a result of my financial problems and not being able to realize my equity

by selling my home, it went into foreclosure, which I have been fighting in

court for 2.5 years. I believe that the person who finally bought it in

April is not going to disclose to his buyer about all of the problems. I

received an eviction notice in the mail on Saturday, which I want to fight

legally, but need a legal theory or stragegy or something (anything)!

Hi Liliane,

I'm so sorry for your misfortune. So many of us have been there. My

heart goes out to you. Have you been to the www.hadd.com website yet?

Perhaps they can give you some advice and/or assistance.

Just try not to look back on all of this. Try to forge ahead with

renewed vigor from being released from a sick house.
