Guest guest Posted November 19, 2004 Report Share Posted November 19, 2004 At my third workman's compensation court appearance yesterday the judge found that the Independant Medical Exam, as well as Dr. Shoemaker's assessment, placed the school at fault for my illness. (due to fungal exposure) So at my next date, in january, I find out waht winning actually means. In New York State they cap your earnings at 400 a week, and the fee for your attorney comes out of that. Poor " compensation " after 23 years of teaching. Ive been out all summer (was always summer school librarian for the county) and didn't return yet this fall due to onset of intence and debilitating MCS. So far with less than a day to absorb the decision, Im not sure how this may affect a chance for a tort lawsuit. Anyone win in other states? In New York? At least now that I can hold my head up in the community and definitively say that the school did this, instead of being the wacky lady who shops in a respirator.
