Guest guest
Hi Rogene. Your questions encompass a wide variety of subjects. First, let me say that I cannot give you legal advice (I know, the old disclaimer) but here are some of the basis concepts. Each person has to speak with a lawyer in their area because the laws vary from state to state, so it really can't accurately be oversimplified. There are specific rules in each jurisdiction which address where a suit can be filed. You also mentioned that the manufacturer's sell nationwide, and that is a very important point in terms of where you are able to file suit. Generally, a defendant has to have some connection or relationship with the forum state to be subjected to that particular jurisdiction's laws. What constitutes enough is the subject of many, many court decisions, and of course varies from state to state. Attorneys have state and federal licenses which allow them to practice in the courts they practice in. There are ways for an out-of-state attorney to practice in a jurisdiction she is not licensed in. Sometimes you have an option of choosing which state you file in. It is fact sensitive, and you have to look at where the parties are located, where the injury or incident giving rise to the litigation occurred, etc. It is difficult to be so general when you are dealing with state and federal civil procedure, but I hope this helps some. I haven't heard anything. I read so much or rather try to, from all you ladie that I have everything confused. I'm really depending on my attorney, but I haven't heard from him in a long time. I've had 10 different saline implants and I do have every symptom or problem in the world. The many different doctors that I have seen, will just simply look at me as if I'm crazy and does nothing. The only one thing that has been said to me by a doctor was that all the problems that I was having was caused by an auto-i mmume problem (eye doctor), then he recanted on me, said that he never told me that.
