LEGAL PROBLEM WITH KACEY'S CLASS ACTION- IMPORTANT!!

A few months ago I posted a notice asking to speak with women with

defective implants. After I posted, Kacey posted a similar notice

for her cousin McDonnell, who is an attorney in Texas. Many of

you have contacted to help you with your case.

I have tried to explain why Texas was NOT an appropriate forum for

defective implant cases. Please read the email I just received from

I have been speaking with Kasey Long. Currently, I have been in

touch with around 30 girls with saline breats implants. Is this

considered bragging? Just joking. The girls all have breast implant

problems.

However, Texas presents a problem when trying to compensate the women

judicially. We passed tort reform this past year that pretty much

bars a products liability case for products that are FDA approved.

The saline breast implants are FDA approved. Therefore, Texas does

not lend too much help.

When you get a second, call me and we can discuss options.

As you can see, there really are many things to consider here. I

would like to help, but I cannot do that if I can't get a group of us

To all that responded to my attorney, ,

I just wanted to let you all know what I have found out. The

lawsuit that I was trying to start is not going to be able to go

into effect.

The following is an email I just sent to Indysurvivor:

Hi Sawyer (Indysurvivor),

Thanks so much for answering 's email so fast. I had called

him this past week for an update on everything he's doing for me,

and then he contacted you. I'm sad to find out that because the FDA

approved saline implants, there cannot be a product liability case.

I know this is unfair. You are very right when you say that this is

a complicated legal matter, and we are all privileged to have you

working on this case for us. I will be posting on the message board

to let the women know what I have found out.

I am disappointed that a lawsuit will not come out of this, but

hopeful that you'll be able to find some way to get women

compensated for the horrible things that has been done. As for me,

I will keep trying to bring awareness to this issue and hope that

someday we'll be able to be fairly compensated for the injustice

that has been done to us.

I am sorry that this lawsuit will not be able to go into effect. I

know that we are in good hands with Indysurvivor looking out for us

and working through the legal system. I, too, will particiate in

any lawsuit that takes effect. I thank you all for joining with me

to try and help make this injustice to women right, and look forward

to banning together with you guys again when the right lawsuit comes

along.
