Information on how to submit comments on the proposed draft rule, chapter 3301-51, for the education of children with disabilities. Information on how to view the draft as well as how to submit comments follows my signature. I had previously shared a schedule of the regionial rule meetings, but have listed it again at the end of this email. If you can, please look these rules over and submit your comments.

SUBJECT: Proposed Rule Timeline and Process for Commenting on the Proposed Rule

The Ohio Department of Education, Office for Exceptional Children (ODE/OEC) wishes to announce the release of the proposed draft rule, chapter 3301-51, for the education of children with disabilities. The proposed draft rule is available on the ODE web site at www.ode.state.oh.us (keyword search Proposed Rule Amendments). The proposed rule amendments are listed by rule number in PDF format.

The Department is seeking public comment on this proposed draft rule. All comments regarding the proposed draft rule must be submitted to ODE/OEC by Monday, May 28, 2007. Please submit your comments electronically via the ODE web page by visiting:

Then click on comments beside the rule number you are referencing and this will bring up the comment form. When finished entering your comments, click submit to send the comments to OEC. A printable comment form is also available on the web page, and you can mail the form to Drvota, Ohio Department of Education, Office for Exceptional Children, 25 S. Front St., 2nd Floor – MS# 202, Columbus, Ohio 43215 or submit the comment form at one of the regional meetings.

The schedule that will guide OECs adoption of the rules is as follows:

3/22/2007: OEC met with the State Advisory Panel for Exceptional Children (SAPEC) Ad Hoc Rules Review Committee to discuss plans for updating the Operating Standards (rules). OEC received the committee’s comments and suggestions.

4/12/2007: The Ad Hoc Rules Review Committee reported to the full panel. OEC presented a draft of the proposed rules to the entire advisory panel and responded to questions and comments.

4/30/2007, 5/1/2007, 5/2/2007, 5/10/200 and 5/11/2007:

Regional meetings on the draft of the proposed rules will be held. The dates, times and locations of these meetings are available on the ODE website, via the link above. (OR SEE BELOW)

5/9/2007: Continuation of discussion with SAPEC of the draft presented on April 12, 2007.

5/28/2007: OEC will be accepting written comments on the proposed draft rules until Monday, May 28, 2007.

6/20/2007: SAPEC will comment publicly on the revised draft of the proposed updated standards.

12/2007: Public hearings on the proposed rules are scheduled before the State Board of Education and Joint Committee on Agency Rule Review (JCARR).

3/1/2008: The final updated rules are scheduled to take effect.
