Winkelman v. Parma City Schools -- Implications of the Decision for Parents

I have to say, after having read the decision last night, even if a

parent is not considering representing their child in court, the

Supreme Court did quite a few favors in this decision for and Jane

Q. Parent. They did not, of course, change anything in IDEA (that's

not their job), but merely clarified what was already there. The Court

listed and affirmed what parental rights are conveyed by IDEA, how

important it is that parents are involved in the entire process, and

what our role is as parents in making sure our child receives FAPE.

The Court also went on to refine the definition of FAPE.

If any of those situations are of concern to you and your child's

particular school situation, I would suggest reading the decision. You

can find it on the Internet (specifically, check out slaw.com).

I've heard many people say that the Winkelman decision won't impact

that many parents...after reading the decision, I would disagree quite

strongly.
