We've been through something possibly similar with an improper restraint by a teacher with my ASD child (grabbing by the neck, throwing down and restraining by the neck. No special ed lawyer I spoke with was interested in handling this case. The state office of professional conduct won't investigate it. I'm working with an educational advocate that won't even return my calls or file the blasted complaint with the state yet and my child has to go back to school and face this witch every day. There really is no justice for our kids is there? If your situation is similar, please let me know what avenues you've pursued. And, in the end, that was like fighting Goliath...except the little guy didn't win this time. There is a national group that is trying to push for federal laws prohibiting the use of seclusion, restraint and institutionalized abuse of special needs children. You can find them here: http://familiesagainstrestraintandseclusion.blogspot.com/2007_08_01_ar chive.html . They have complied a list of 108 schools so far in 33 states that have used aversive " interventions " on special needs children. You might want to tell them your story. I firmly believe a federal law is the only chance we have at stopping these practices in public schools. We cannot rely on state laws...Ohio doesn't have any to stop this type of abuse in schools...hospitals and prisons -- sure...but not schools. I am very fortunate that my son is high functioning and can tell me the details (eventually) of what goes on. Being made to hold a pillow over his face and scream into it and spending up to 45 minutes in timeout room were some of the other improper ways the school dealt with him this past year.
