I am the lead attorney on the above referenced case. It came to my attention that attorney Judith Salzman provided some information to you to disseminate that was incorrect. Ms. Salzman's comment appears at the end of this message. She states that parents can opt out of the class of individuals who are plaintiffs in the case. Parents can file objections to the agreement but they can not opt out of the class. Please feel free to call me if you need additional information about this or about the case in general. We believe that the agreement is beneficial to students with disabilities and their parents and we want them to have accurate information about the case Thank you for your assistance in increasing awareness of the positive changes that will result once the Court finally approves the agreement.

OLRS has settled a class action lawsuit against ODE involving a variety of matters, including the way that ODE handles complaints filed by parents. I think it would be wise to publicize this on your list serves and newsletters, as parents should be aware of the proposed settlement, and also of their right to opt out of it.
