Columbus NBC4 to host third Autism Special, August 12, 7pm, ASO President on Daytime Columbus, August 11Be sure to tune in at 7pm on Wednesday, August 12 for the third installment of NBC4's autism series, The Autism Puzzle.  The topics to be covered in this special are: Physical Therapy, Insurance status, Helpful tips for parents about financial funding and Adult daycare.  There will again be opportunities to call in and email with NBC4's Call4 and iChat features - manned by members of the Autism Society, and staff from OCALI and OSU's Nisonger Center.  Watch for a new " commercial " on ASO that will be airing during the special.

Additionally, ASO President, Sawan Caruso, will be a guest on NBC4's Daytime Columbus, hosted by Gail Hogan at 11am on Tuesday August 11.  Be sure to tune in!Links to both programs and ASO's new spot will be provided in next week's DIGEST.

Governor Strickland Signs Executive Order Establishing Physical Restraint Policies for State AgenciesFrom the ODMRDD E-newsletter Pipeline:On August 3, 2009, Governor Ted Strickland signed an executive order that bans prone restraint across all state systems and sets specific policies for other types of physical restraints.

According to the news release of the same day from the Governor’s Office, he stated, “Some state employees’ job duties require them to handle situations that may pose potential injury to themselves or others, and may require their intervention through use of a physical restraint.  It is critical that we protect the safety, dignity and respect of both the state employee and those in the care of the state.â€Â  He continued, “This executive order establishes minimum acceptable standards to make sure restraint is used properly, by a trained individual, and only when absolutely necessary to ensure safety and prevent harm.â€

This policy is the result of a seven-agency work group that studied the use of physical restraint at the respective agencies when providing services.  ODMRDD was the lead on the work group efforts and had banned the ‘prone restraint’ position in November 2008, due to the belief that it posed an unacceptable risk to health and safety.  Prone restraint involves the restraint of an individual in a face-down position for an extended period of time. The November 2008 ban applies to all providers of services to individuals with disabilities who receive funds directly or indirectly from the ODMRDD to provide a service or support to an individual eligible for County Board of Mental Retardation and Developmental Disabilities services. -----------------------------------------------------------------------------------------ODMRDD implementing new Provider Certification RuleFrom the ODMRDD E-newsletter Pipeline:

The ODMRDD is making preparations for implementation of the new Provider Certification rule (5123:2-2-01).  The rule will implement, for the first time, the Department’s existing statutory authority to time-limit provider certification and collect application fees for providers of Supported Living and Home and Community-Based Services waiver services.

The rule is responsive to several MRDD Futures Committee recommendations and represents a shared commitment throughout Ohio’s developmental disabilities community to create a better service delivery system.  A copy of the rule is available at the Department's website (http://mrdd.ohio.gov/rules/development.htm).

The rule streamlines and simplifies rules by replacing three existing rules regarding provider certification (5123:2-9-09, 5123:2-12-02, and 5123:2-12-06) with one rule.Details regarding implementation of the rule are forthcoming and will be broadly disseminated.  For more info, Contact:  Becky at becky.phillips@...

Voices for Ohio’s Children, in conjunction with the Ohio Chapter of the American Academy of Pediatrics, will facilitate Regional Briefings across Ohio during August 2009 to inform local advocates on State and Federal Children’s Issues.  The objectives of these sessions are to:

Ohio Governor’s Council on People with Disabilities In

April 2009, the U.S. Department of Labor listed people with

disabilities in the labor force at only 22.8% as compared to 70.9% for

people without disabilities. Surveys have shown over and over again

that individuals with disabilities want to work. However, the current

opportunities and services to support people with disabilities in

gaining employment are not working.

Now is the time to hear from people with disabilities themselves about how to make positive change.This

forum will provide an opportunity to inform policymakers about personal

work experiences. People with disabilities, their families, friends and

people who serve them are encouraged to attend this open forum and

share their employment experiences, successes, barriers, frustrations

and suggestions.

Register today! Come and give your personal testimony. Make your voice heard.Free

and open to the public. Come prepared to provide oral (not more than

five minutes) or written testimony, or to support those who are

presenting at the hearing.

All testimony will be recorded and a summary will be prepared. The

final report will include recommendations to improve gainful employment

for people with all types of disabilities. It will be shared with

people who can make a difference—service providers, legislators,

government officials, employers and others.

By Alan The Columbus DispatchThe 6th U.S. Circuit Court of Appeals has upheld a ruling that the state cannot eliminate or drastically curtail Medicaid services for autistic children.The appeals court, in a ruling reached late last week, said U.S. District Judge L. Graham did not exceed his authority in granting a temporary restraining order that prevented new state Medicaid rules from taking effect on July 1, 2008.

The state has continued paying for the services pending appeal.The Parents League for Effective Autism Services, a group of families of autistic children served by Step By Step Academy in Westerville and represented by Ohio Legal Rights Service, sued the Ohio Department of Mental Health and the Department of Job and Family Services over the proposed changes.

State officials said the changes are necessary to keep Ohio in compliance with federal Medicaid regulations. Parents countered that the rules violated their rights to service under Medicaid.The appeals court did not rule on the heart of the lawsuit which the court said focuses on " an ambiguous federal Medicaid provision. "

Federal Update

Redesigned Disability.gov Web siteThe U.S. Department of Labor this week launched Disability.gov, a redesigned federal Web site that connects the more than 50 million Americans with disabilities to thousands of trusted resources on disability-related issues, programs and services. Formerly known as DisabilityInfo.gov, the site has been completely redesigned and updated with new social media tools, such as a blog and a Twitter feed, to encourage feedback and interaction among visitors. Disability.gov is not just for Americans with disabilities, but also for parents of children with disabilities, employers, workforce and human resource professionals, veterans, educators, caregivers and many others. Disability.gov features comprehensive information from 22 federal agencies, as well as educational institutions, non-profit organizations and state and local governments. Topics covered on the site include: benefits; civil rights; community life; education; emergency preparedness; employment; health; housing; technology; and transportation.

The following info provided by the Disability Policy CoalitionHealth Care ReformHouse Energy and Commerce Committee Chairman Henry Waxman (D-CA) reached an agreement, after extensive negotiations with fiscally conservative Blue Dog Democrats on the Committee's health reform bill.  Changes were made to lower costs and to modify the bill's employer mandate. Many of the changes angered liberal Democratic members.  After a marathon mark-up session where scores of amendments were considered, the Committee passed the bill by a vote of 31-28.  Five Democrats joined all Committee Republicans in voting against the legislation. Staff of the Energy and Commerce, Ways and Means, and Education and Labor Committees will spend August reconciling their respective bills in preparation for a House vote in September. Senate Finance Committee Chairman Max Baucus (D-MT) announced that his bi-partisan negotiating team would not reach an agreement before the Senate leaves for its August recess.  Sens. Max Baucus, Jeff Bingaman (D-NM) and Kent Conrad (D-ND) are negotiating with Ranking Member Chuck Grassley (R-IA) and Sens. Mike Enzi (R-WY) and Olympia Snowe (R-ME).

Social SecurityOn July 28, the House of Representatives passed the WIPA and PABSS Reauthorization Act of 2009, H.R. 3325, which was introduced by House Ways and Means Social Security Subcommittee Chairman Tanner (D-TN) and Income Security Subcommittee Chairman Jim McDermott (D-WA).  The bill amends the Social Security Act to extend through Fiscal Year 2010 the authorization of appropriations for the Work Incentives Planning and Assistance (WIPA) and the Protection and Advocacy for Beneficiaries of Social Security (PABSS) programs.  The WIPA and PABSS programs were established by the Ticket to Work and Work Incentives Improvement Act to assist Supplemental Security Income (SSI) and Social Security disability program beneficiaries with information about existing work incentives, benefits planning, and decisions about work and providing advocacy that beneficiaries may need to secure, regain, or maintain gainful employment.

Health and Human Services Secretary Kathleen G. Sebelius US Signing of the United Nations Convention on the Rights of Persons with DisabilitiesJuly 30, 2009, the United States joins 141other nations who have signed the United Nations Convention on the Rights of Persons with Disabilities.   The signing of the UN Convention sends an important message that this country is committed to equal rights for people with disabilities, in the United States and around the world. 

Another important example of our commitment is the President’s launch of the Year of Community Living in June.   The Department of Health and Human Services has already begun to carry out the Community Living initiative by establishing an HHS Coordinating Council, led by the Office on Disability.

The Administration on Aging, the Centers for Medicare & Medicaid Services, the Office for Civil Rights, the Office of the Assistant Secretary for Planning and Evaluation, the Substance Abuse and Mental Health Services Administration, and—most recently—the Health Resources and Services Administration, the Administration for Children and Families, and the Office of Public Health and Science have joined the Coordinating Council.  I am pleased that we have assembled such considerable expertise to ensure that living independently with a disability is a real choice.

HHS is proud to support the Convention on the Rights of Persons with Disabilities, the first new UN human rights convention of the 21st century.  We look forward to advancing dignity, autonomy, full inclusion, and equality of opportunity for Americans, and for people with disabilities around the world.

 Request for Information (RFI): Updating the Interagency Autism Coordinating Committee Strategic Plan for Autism Spectrum Disorder (ASD) Research

On behalf of the Interagency Autism Coordinating Committee (IACC), the Nation Institute of Mental Health is seeking comments to inform the annual update of the IACC Strategic Plan for Autism Spectrum Disorder (ASD) Research - http://www.iacc.hhs.gov/reports/2009/iacc-strategic-plan-for-autism-spectrum-disorder-research-jan26.shtml as required by the Combating Autism Act of 2006 (P.L. 109-416).

The purpose of this RFI is to solicit input from ASD stakeholders to inform the next update of the Strategic Plan.   In the RFI form, there will be an opportunity to provide input on each section of the IACC Strategic Plan.  Please include suggestions regarding missing or underrepresented knowledge areas, new opportunities needed for advancing research and knowledge about ASD, and suggestions for prioritizing research objectives.

Background:

The IACC was established as a result of The Combating Autism Act.  The act requires that the IACC develop a strategic plan for autism research and update the strategic plan annually. The IACC is composed of both Federal and public members.  The first IACC Strategic Plan for ASD Research was developed through an extensive process engaging a wide range of Federal agencies and public stakeholders.  The Strategic Plan is organized around six questions that are important for people with ASD and their families:

I.      When should I be concerned?II.     How can I understand what is happening?III.    What caused this to happen and can this be prevented?IV.     Which treatments and interventions will help?V.      Where can I turn for services?

VI.     What does the future hold?Please Note: The responses that you provide will become part of the public record.  You have the option of posting your responses anonymously or you may choose to have your name associated with your response. In your responses, please do not include personally identifiable information that you do not wish to make public.

forum is to educate attendees on the complexity of autism through

Toledo Children's Hospital Total Rehab is looking for participants for a free training parent education program called It Takes Two to Talk for parents of children with autism ages birth-5.

In 1995 The Hanen Center adopted a program to meet the needs of children with Autism Spectrum Disorder (ASD) and related social communication difficulties. The It Takes Two to Talk Program is a parent education program which empowers parents by giving them tools to facilitate their children & rsquo;s interaction and communication skills. Toledo Children's Hospital is offering this program to interested

families through grant funds awarded by the Give Autism the Boot Campaign. This program will be offered to families with children from birth-5 years.The It Takes Two to Talk Program: -Emphasizes the child's everyday activities as the context for learning to communicate.

-Emphasizes the importance of affect, predictability, structure, and the use of visual supports to   enhance learning in children with ASD.-The program will accommodate eight to twelve families for 12 weeks, and is led by Hanen Certified Speech Language Pathologist, Cecilia Dunn, MA., CCC-SLP.

The program will include:An orientation meeting.A pre-program consultation.Eight group training sessions for parents (about 2 & frac12; hours each).Three individual video feedback sessions for each family, conducted by the Speech Language Pathologist.

A written report by the Speech Language Pathologist.Parent evaluation of the program.This program is not designed to replace other treatments for children with ASD. If you are involved in other treatments, such as Applied Behavior Analysis, you are encouraged to share this information with the Speech Language Pathologist leading the group.
