To ensure that you have a copy, please e-mail bethcerda@... by 9/5/2009 --------------------------------------------------------------------Ohio Budget Bill, updateThe following information is provided to us by Dodge, a lobbyist with Dunn and Associates who works with the Autism Society of Ohio pro bono. We provide you this information to make you aware that while programs and services have been cut under the Ohio budget passed in July, even if the economy picks up, there could still be more cuts in the future. ASO will keep you updated on issues that may impact individuals with autism as they come up under the budget. Just wanted to provide an update in terms of what we might see relative to a budget corrections bill and what outstanding issues might have an impact on the budget. The General Assembly is scheduled to reconvene for committee hearings the week of September 7 with the first scheduled session date of September 15. As the summer winds down, there are several court cases passed, pending and on appeal which could impact the size and nature of the budget corrections bill. A correction bill could be introduced as early as fall. Currently there are four legal cases pending which could have a significant impact on the bottom line for the state’s current two year operating budget:1. Video Lottery Terminals (VLTs) = $933 million – The Governor is aiming to have the VLTs up and running by May 2010 in order to meet the state’s budget projections. The state Supreme Court will begin to hear oral arguments on September 2 as to whether VLTs are constitutional. 2. Tobacco Funds = $258 million – a lin County court ruled last week that the state cannot use the tobacco funds as they did in HB 1 – the state will appeal the ruling.3. Unclaimed Funds – a lin County Common Pleas Judge ruled in 2006 and the Supreme Court upheld in April 2009 that Ohioans who recovered unclaimed funds held by the state are entitled to interest. The lin County Common Pleas judge ruled this week that anyone collecting $25 or more after August 4, 2000 is entitled to 6% interest as well as additional interest because the state stopped paying interest on unclaimed funds in 1991. The price tag for interest on unclaimed funds is rumored to be in the hundreds of millions. 4. Grocers/CAT tax – Ohio Grocers have a legal case pending which could deem the CAT an excise tax – if the court rules in their favor and includes a “look back” period, the price tag could be as high as $400-$500 million. With the aforementioned issues pending legal resolution, the worst case scenario in terms of a budget hole for the current 2010-2011 state operating budget could be as high as $2 billion.-------------------------------------------------------------------------------------------- From ODMRDD: New IO Waiver Service Proposal: Adult Family CareDistributed to ODMRDD Family Advisory CouncilAugust 19, 2009 *Please note that the following proposal is being submitted in draft form for the sole purpose of gathering feedback from families and other stakeholders. No administrative code rules have been put into clearance or filed and there is no proposed effective date at this time. BackgroundWhen a state submits their home and community based waiver application to the Center for Medicare and Medicaid Services (CMS), they must choose whether to allow family members to provide services. Many states have made the choice to exclude family members from being paid providers. However, Ohio has made the decision to allow family providers for adult individuals enrolled on the IO and Level 1 waivers because often it is in the best interest of the individuals served to remain in their family home and receive services from those who care most about them. Care within the family home also provides opportunities for natural supports which encourages more economical service delivery especially since services are not being shared. Today there is a variance between natural supports provided by families who are also paid providers across Ohio. The costs of individuals who live with and are served by family members or guardians have become difficult to predict and vary from county to county. Homemaker/personal care delivered in the family home has become administratively burdensome to document and is inconsistent with similar methods of service delivery (i.e. Adult Care). For these reasons, the department has identified a new Adult Family Care service as one of the ways to address the long term fiscal sustainability of the IO waiver and to preserve the option for family providers that exists today.Adult Family Care ProposalAdult Family Care is a new waiver service that would apply to adult individuals (18 years of age and older) who live with a family member who is providing Homemaker/Personal Care (HPC) services as a paid I.O. certified waiver provider. The service is similar to Adult Care because it establishes a daily rate for homemaker/personal care services, but it is different from Adult Care because it allows a second, more flexible service delivery option. Draft Service Definition " Adult Family Care " means personal care and supportive services (e.g., homemaker, chore, and medication oversight to the extent permitted under state law) provided in a private home by a care giver, who is related by blood or marriage, who lives in the home and whose primary, legal residence is that home. Adult family care is furnished to adults who receive these services in conjunction with residing in the family home. Adult family care services, their associated activities, and skill development are part of the rhythm of life that naturally occurs as part of living in the family home. Homemaker and chore services are furnished to the individual as a component of adult family care. Due to the environment provided by family care, segregating these activities into discrete services is impractical.</para_first>The term “family” as it applies to Adult Family Care means parents; grandparents, including grandparents with the prefix " great, " " great-great, " " grand, " or " great-grand;” siblings; aunts, uncles, nephews, and nieces, including such relatives with the prefix " great, " " great-great, " " grand, " or " great-grand; " stepparents or stepsiblings; and spouses and former spouses of individuals related by blood or adoption. Service Delivery OptionsIn order to address the need many families have for flexibility, the department is proposing two service delivery options. Each individual receiving Adult Family Care must choose one of the two options for service delivery and that choice must be recorded in their Individual Service Plan (ISP). * Option 1 will offer simplified billing and documentation for those families that already provide all or most of the HPC services to an individual. The family provider will bill the daily rate that is applicable to the individual’s Ohio Developmental Disabilities Profile (ODDP). The table below contains the daily rate for each ODDP grouping. A non-family member who is a certified provider may bill for a day of respite only when a family member has not billed for Adult Family Care services on that same day. Prior Authorization (PA) may be considered if respite or other waiver services (i.e. transportation, home modifications etc.) put an individual over their ODDP funding range, but the daily rate is a fixed rate. * Option 2 will allow flexibility to those families who utilize non-family providers on a regular basis (in addition to the family provider), especially those who choose to split days between a family and non-family provider. In either case, the costs at the end of the waiver year will be the same or nearly the same. The family provider and any other non-family provider may continue to bill HPC in 15 minute units and their documentation requirements will remain the same. However, HPC services are subject to the same annual cost caps as in Option 1. In other words, an individual’s total HPC costs for the waiver year cannot exceed the applicable daily rate x 365 days. PA may be considered for the costs of waiver services other than HPC (i.e. transportation, home modifications etc.) RatesThere are four proposed daily rates which apply to ODDP groups as illustrated in the table below. The proposed rates are based on the current costs of homemaker personal care services delivered to adults identified as living with family and utilizing a family provider. The same rate applies to both independent and agency providers. Agency providers that employ direct care staff who live with and provide services to a family member who are enrolled on the IO waiver will be subject to the Adult Family Care rate. The daily rate will be adjusted according to the cost of doing business (CODB) county of the individual. The following table contains the rate bands for an average CODB county.
