Guest guest Posted October 15, 2000 Report Share Posted October 15, 2000 hi shelly, welcome!! glad you are here. no you do not have to belong to any particular religion in NY state to claim a religious exemption. but, you do need to be careful and don't volunteer any info about your religion or any of your beliefs--it's unnecessary and may come back to haunt you when you do put in your exemption. there are however some school districts that will try to force you to " prove " your religious convictions before they grant you an exemption--this is a violation of your rights in NYS. there is no personal exemption in NY--unfortunately. have you begun your exemption process yet? have you contacted anyone about writing an exemption yet? where in NY are you located? i am in NY also, and will probably need to do an exemption next year (my now 6 yr old was fully vaxed up to age 5--before i knew better--so when i entered him in kindergarten i didn't have the problem i will now). when you go to register your child there should be a section on the back of the registration form that you need to either sign stating that your child will be fully inoculated or mark no they won't be and that is where you would attach your religious exemption. here is a website of an attorney who does tons of ny exemptions--check out his webpage: www.immunizationattorney.com there are a few other sources i can locate for you but i am very pressed for time right now--i will write later!! ) brigit Quote Link to comment Share on other sites More sharing options...

They have no right to ask what religion you are. Immunizations of a person shall not be required for admission to a school or other institution if the guardian parent or adult has assumed responsibility for his or her custody or care in the case of a minor, or the person seeking admission themselves, files with the governing authority a letter or affidavit stating that such vaccination is contrary to his or her belief. In addition, the Supreme Court has noted that nontraditional beliefs, including secular humanism, atheism and nontheistic faith, ae all " religion " for the purpose of free exercise analysis. Fowler vs. Rhode Island, 345 U.S. 67 (1953) held that it was " NO BUSINESS OF THE COURTS TO SAY WHAT IS A RELIGIOUS PRACTIVE OR ACTIVITY FOR ONE GROUP IS NOT RELIGION UNDER THE PROTECTION OFTHE FIRST AMENDMENT. " I use it in my exemption letter.. and they still have the " nerve " to ask me what my religion is!!!!
