You need to do some research on workers comp in your state. Also, you could just

plain ask them before accepting the offer. Oh, and check with your regular

medical to find out if they will cover you even though it started out as a

workers comp injury. Maybe its more beneficial to take higher cash and move to

your other medical, on the other hand if you are gonna need future medical you

get it in writing as part of the settlement that they will cover all medical

related to your injury and take less money.

I was offered a crap settlement back in 2003 and boy am I glad I didnt take it.

It came with no future medical and it wasnt even a years worth of wages. I

refused to settle and then got myself a lawyer that only gets paid when I get

paid. So I didnt have to put any money down and I dont pay him anything unless I

receive money from workers comp and its taken directly out before I see it.

I havent actually reached my actual settlement, cause I had been put back on

temp disability (which I fought for) and then when they tried to settle later on

I again refused pending the stimulator and that it was unfair. Thanks to my

stubborness I have been evaluated by surgeons, specialists, and psychiatrists

both back in 2004 and again in 2008 with all doctors noticing a huge decrease in

my abilities and had psych added to my settlement. They tried to refuse this

originally but I fought until I got it across that my depression was because of

my injury. A lawyer can help you defend yourself and tell you your rights. If it

werent for my lawyer I wouldnt even have been evaluated and also I wouldnt have

a stimulator....I am now waiting for my next settlement hearing date. The lawyer

fought for me on all levels...doctors, meds, surgeries, etc etc.......

Please do your research and if you need to a lawyer so you dont get

screwed....they will try to low ball you in order to dump your case and then you

end up feeling screwed and will have no recourse if you do get screwed.

Hi Group,

Has anyone had experience with the comp carrier offer a cash settlement

for you injury? In other words, getting your injury off the books...My

comp carrier has approached me saying they would intertain the idea of

a cash settlement. If this were to take place, would I then be

responsible for any Dr bills on my back or would my health insurance

kick in?

The insurance company offered me a cash settlement on future medical.  My pain

management doctor told me they do this, to be relieved of their responsibility. 

They offer what sounds like a large settlement, but in the long run it is not

enough to cover a lifetime of medical bills.  If you receive SSD and have

medicare, the way I understand it you have to show that your settlement is used

to cover expenses before they will cover costs. You do need to ask a lawyer

before you make a decision.

 

Having worked for an insurance company, I can tell you that they are not in the

habit of offering money for YOUR benefit.  They are looking at " saving

themselves a dime. "

I also am going through with what called comutation workers comp buy

out. My stipulation is that all medical will still be future covered

by w/c Due to having a stimulator which needs to be matained and

seeing that i am on medication so all these must not be settle so w/c

will buy me out of payaable income. my lawyer is taking over with

this. he said my case is upper 6 figure amount we are waiting for

there offer. I added up my life time income it is near a million if i

dont get 900 thousand or more i will reject offer. and still get that

money by staying on total perment disability my woorker comp pays me

$1420 a month if you added that up i am 37 my life expectionally is

77 years due the math. im not going to settle for anything less.

becuse i will get the amount i want by staying on w/c oh also ssdi

involed in this due to people taaking a buy out then putting all

medical on ssdi instead on w/c so it a lenthy process we will see

w/c has already haas done there report they have not sent it yet to

my lawyer. mike group owner

I have altready had a settlement. i was refering to a w/c buyout

where workers comp would only be liable for future medical everything

else would be my responsibililty. mike owner

Good morning,,, I have a sister in law that has RSD due to a work

injury.Awhile back they did a settlement,,, they put x amount of money

into an account for medical expences, she said it should be enough to

last the rest of her life,she just had a huge pool and deck put in,,

said it helps her RSD pain,, yeah right,, but anyway, they way she

talked they gave her a bunch of money plus she is still recieving her

paycheck every two weeks plus recieving SSD.We live in Ohio,, dont

know how other states do it,,,,

Have you been turned down twice and now you are waiting on a ALJ

hearing, is this what you are saying? 31/2 yr's sounds like a very long

time. Before I got my hearing Date I call my congressman, he told me

they cannot interfere with the case, but they can find out where your

case is. After I talked to him and before I could talk to him again I

received a letter with a Hearing Date. So I don't know what to say if

he helped move things along, but it cannot hurt. Good Luck

-you are 100 percent correct. my lawyer told me it could be until

year after you agree due to medicare ss there involved in the

process. Idont think i will settle becuse I am asking alot. mike
