Guest guest Posted June 11, 2003 Report Share Posted June 11, 2003 Pawan, I am glad that Indian's are getting worked up about practices that in our country (Australia) would be classified as criminal negligence and we all have the same legal westminster system from the UK as our legal base. We just had a court award damages to the wife of a positive man after they both tested before marriage but the doctors refused to disclose the husband's +ve status and he didn't either. She sero converted from him after they married and the Court awarded damages of AUS $700,000 which is nearly 2 crore in rupees I think. Seventeen and a half million rupees is the numbers at todays conversion rate. What will change the negligent practices in India is when the courts have applications from aggrieved Indians and the damages start to be awarded. The same applies to blood banks of which there are about 9000 in India I understand who also fail to disclose the status of positive contributors with disasterous implications. The pvt doctor's and lab insurers will make the difference and it will happen overnight.
