The person being a board member is personally legally liable for the welfare of all employees and her statement sounds to me like employer's negligence. The board member's liability I believe is equal to the liability of the employer and her comment to you may be evidence of considerable neglect on the part of the employer.. The statement IMO is evidence of a decision to do nothing about a hazardous situation. If you are on the books as an employee and not as a 1099 subcontractor or social volunteer there are considerable labor laws to protect you if you develop a condition relating to mold on the jobsite.. My employer tried to get me to go back to work saying their remedial measures had " worked. " Yet, stachy showed up on the newest report. So, I sent him a letter saying I would not come back to an environment that will only make me sicker and I was not abandoning my position (he was trying to make me quit I think), so if they wanted they would have to terminate me and I expected a severance. Not sure what will happen, but I'm not expecting it to be favorable, and I am looking for a new job - already have an interview lined up for Tuesday. Re: []* How do you respond?
