I am in florida and am sure will face the same problems - my question (which is a dumb one, I am sure, so bear with me) is: what do we face if accepted for disability? what kind of money are we looking at? I am getting to the point where I really don't think I will be able to handle working much longer and have been thinking about it but just don't see how I will be able to help support family without my income. I guess it a percentage based on what has been paid in? sorry for the questions but I am sitting at home now - had to take the day off again from work as I feel so bad and am just wondering if we could make it if I was accepted. my god - I can't believe I am even talking about this - I am only 33 and thinking about ss. My hubby has a good job but as most families these days, we require 2 incomes to pay our bills. I do have long term dilability benefits with work but I am not sure how hard it would be to qualify, if at all, and they only pay 60% although I guess that isn't so bad. Any more news on lawsuit atty's? I know you had a problem with your guy in Texas with the state laws,etc.

You have to be off work for 5 months to even apply. But the minimum is

about $575 a month. It depends on how much you are and have been earning.

well the company I work for I guarantee will not take me back if I claim disability - they are real weird about stuff like that . my job is pretty stressful and I am the only insode sales contact with NO backup so anytime I miss - even with the surgeries last year I caught hell. It is a serious ordeal when I am out as there isn't really anyone to cover and the position isn;t one that can "wait" until the next day - there are many calls that come in and must be handled. they are not the most understanding people in the world although they claim to be. I don't blame them in a way but it is hard as I do pretty well there and changing jobs or quitting work would be a serious hardship on my family - we would probably have to go bankrupt which i really don't want to do as we have good credit but I guess we do what we must to get better.

Yea! I've missed you, Kacey! That's so cool that you are making progress. My lawyer said it would be several months before anything happens, so I just have to be patient, I guess. My poor husband runs his gym during the day and works at FedEx in the hub at night. I feel so guilty, but there's nothing I can do. I have sold some paintings tho which helps a little, but not enough. I was making more money than my husband, so we are really missing my paycheck. Oh well....Take care Kacey, I love you! - Colleen

I completely agree with you on hiring a disability lawyer! I was

told the exact thing (I'm in Texas), that it's almost impossible to

get disability without a lawyer. A year ago I filed for disability

myself...and was turned down twice. I then had a lawyer file, and

I'm finally making progress with the social security office. It

really looks like I should get disability in the very near future.

when I started getting too sick to work, I talked to someone at work about disability or taking a leave of absence. about three days later, they fired me. that was a year ago. now, my husband and I are struggling. we have two new cars and a nice big mortgage...which was all fine when I was working. we are trying to sell our cars and my husband is working two jobs. we've been threatened numerous times of foreclosure and repossession of our cars. we explained to them what we are going through and they have been working with us and being surprisingly helpful. it is hard, but you do what you have to do. you have to take care of yourself.

I probably should have done something like that to protect myself from being fired, but I was so out of it. I couldn't think straight and I was sooo depressed and in so much pain. I just wanted to get out of there. That is really good advice though.

The laws may differ from state to state but the EEOC is a federal agency. My sister suffers from CFS and Fibromyalgia and when she became pregnant she got really sick and missed a lot of work. She over heard her boss talking about firing her, so she went to her doctor and had him write a letter to GE, where she works, saying she was very sick and needed to take time off until she delivered and then the usual six weeks and that he was putting her on disability (through her work policy). She gave the letter to her boss along with a copy of a letter she had written to the EEOC (she spoke to someone there and sent the letter to a specific person) saying she was soooo afraid of being fired because she was out sick. That was seven years ago and GE had no choice but to keep her. She has been back at work for 6 years and if she needs time to go to the doc or she is sick, her boss is most understanding.

Writting to the EEOC and attaching her letter to them was the smartest thing she could do. The EEOC wrote back to the HR department and her boss explaining the law for the disabilities act and she could not be fired.

I hope this is helpful to those who have disablity insurance through work.
