I have been through this and because my estranged husband and I both had

legal custody, and I had physical custody, he took her to a never been to before

pediatrician's office and had her vaccinated with everything they had on a

day when he had her for visitation without my knowledge or consent. She was 4

at the time and I was so beaten down by the whole bad marriage situation that

the my best response was to threaten him with court and money out of his

pocket to defend himself if he ever did it again. He did it because he was mad

at me and wanted to hurt me which he did but he hurt her much more and she

was affected by them but fortunately nothing life threatening as far as I know

at this point.

So, it might be hard to get full legal custody though even with joint legal,

they are supposed to consult with you for all medical procedures and visa

versa. I hope yours isn't as big a jerk as mine was!!

I didn't get the impression that you were divorcing. I just wanted to relate

slightly with my story.

But he can as her father, get her vaccinated at any time that he chooses

even if you have something written. He has as much legal right to do it as you

have not to do it. Just be aware of that.

Rina,

I'm not sure of the legal ramifications in your state between married

couples. I do know that if you are separated or divorced - it would be

a " legal custody " issue - medical treatment (whose responsibility in

the decisions). Honestly, I would contact a lawyer on that one for

your child's protection.

In the meantime though, for the daycare concern...did you grant them

permission to treat in the event of an " emergency " ? If so, add your

own clause that vaccines are not to be administered - period.

Let me say this everyone, although I am highly appreciative of people taking the

time to respond, we are not divorcing at this time jsut having some problems and

I want to make sure I just have some sort of letter in her file re-stating my

stance on her vaxx status. Currently, I have a printed out form for the schools

and Ij ust signed about exempting my daughter from any vaxx but on top of that,

I want something informal in there as well. Nothing more nothing less!

I apologize Mavis for coming off that rude.....I didn't clarify in my original

post that there was no divorce action going on.......but on to the father having

just as much right to vaccinate as I have to not vaccinate her????  I guess what

I want more or less is just more word out within our little world a little more

stronger.

 

I am truly sorry about your previous divorce situation......I don't know what I

would do in that siuation but I'm I'm guessing my motherly instincts would go

into overdrive to protect my little girl. Thank you for your response.....and

forgive me again I am under some major stress!

Not a problem at all Rina! I just wanted to be sure that you understood how

important that it is to cover all the bases in regards to this as I had to

learn the hard way!

I sure wouldn't want to see your little girl vaccinated against your will

especially when you are stressed already. Life is hard sometimes but this too

shall pass for you!

Would it help if you had your husband sign an agreement between the two of

you that you, that he will not vaccinate your child? I know of another

situation where that has worked, and it held up in court. But I don't really

know much more than that.

Honestly Charlotte, I thought of that somewhere in the past and I think I will

put that into play now! Thank you for bringing that idea back up!!!!! He'll

probably freak out a bit, but I need tons of reassurance that he truly
