Breaching patinet confidentality by a Doctor in Goa

A Case of Banaulim in Goa -Breach Of Confidentality.

This is a case where a women has been discriminated at various levels; just

because she was HIV+ and illeterate.The Story comes like that.

The name of Women has been changed to keep Confidentality of Her HIV status.

This is the story of ''Sapna'.

Sapna is a resident of salcete in Goa, Sapna is a 22 Years of old and belongs to

a Poor Family where education doesn't reach to the People, Sapna has two younger

sisters and a Younger Brother who are working as a sales man in a Shop at

Banaulim.

Sapna got married when she was 21 years with a person from salcete itself and

the Husband was working in Kuwait,

she got married a year back when husband had come to Goa and later after thre

months he went back to Kuwait.

About two month`s back her Husband and Inlaws who are staying in Salceter forced

her to go for some Check up,with Sister In Law. Because of Pressure sapna has

gone for testing with Sister-in-law to a well known Doctor at Margao.

She has not been told what sort of Testing and check up was done. Sapna didn`t

know what they are doing,and why they were forcing her to go for all these

Testing and check up .The Doctor also didn't tell sapnma what sort of Testing

and check ups had been done for what reason when she was okay and didn't have

any problem,

A week later Sister-In-Law went to Doctor to Collect reports and other

Information about Sapna, and Doctor gave the report to her Sister-In-Law of

HIV/AIDS. Saying that Sapna is a Hiv+ and said she will not live more then 02

months.

When Sapna went to Doctor, Doctor didn`t feel to take a consent of Sapna for Hiv

and she has just done the test with a consent with her Sister-In-Law, and then

the Doctor gave a report to Sister-In-Law

Sapna Did`nt Knew which test have been done on her and for what reason. The

Sister-In-Law came with the report and started showing to all the members of

family about Sapna Hiv + Report. And then she went to the Neighbour and started

showing her Hiv+ Report, but at this time also Sapna didn't Knew what`s

happening and what the rumour was being spread about her.

Later The In-Laws informed Sapna`s Husband about her Hiv Staus to him by the

Phone, and from Kuwait itself he told to his parent`s to tell her to give a

Divorce and to sign the Divorce Paper`s, and now the In-Laws are forcing her to

sign the Divorce papers and the In-Laws filed a case in Civil Court for a

Divorce.

Sapna says that she does not want to give a Dievorce because if he wanted to

divorce and wanted to spoil life of mine then why he married me and why he had

spoiled my life.She says that In-Laws are telling that they will give a lakh

rupee as compensation if she signs the Dievorce papers. But she doesn't want to

sign the Dievorce paper she is ready to stay like this, and From some where she

got a information that there is cure for HIV in Kerla, then she went with

her sister to Kerla to Majid and he said that there is a cure for HIV .

And he statred her treatment by giving some Ayurvedic Powder which she has shown

to us, Those Medicines just boost the Immune System nothing else and poor lady

is thinking that she will be free of HIV after treatment, for which she is

paying 9,000 rupees for a month and she stated that she is getting abdominal

pain after she statrted those medicines of Majid (Kerla)

We from our network we filed a case in Civil and Criminal Court in Margao,where

on may 3rdthe case day is scheduled.
