It seems the school is not concerned with law, they just want to know what they have to hand into the Education Department in lieu of a vax record. The legal system is based on the UK system but the laws are independent. Hence it is hard to wrok out what is what with such a new thing. I know it is illegal not to go to school, so how can it also be illegal not to vax? They could just be assuming it and maybe no exemption is needed. In the meantime, if you do talk to the nurse or anyone with authority, I would not argue that about the nephew. I'd stick to the religous exemption 100%--with NO details or reasons why. Medical reasons are so iffy to get signed off on. In the US it's either due to a particular vaccine or a particular ingredient. You want to nix all of them? Don't take a chance on medical because you'd have to get a doc to agree. How did she start school without this being resolved? Did they just assume she had them? The school is privately run by a rather eccentric charater (there are lots of them here) & nothing is very sorted out - my friend started her child last term & it was a full month before she got any real paper work for anything! I have an upset in that I have had all the medical papers thrust at me the moment I took my daughter in today due to the fact that 'someone' (remember I live on a small island here) walked into the principal's office last week to inform them that my particular child was not vaccinated & was a threat to the other children. Now I have to deal with personal thoughts of cloak & dagger people in that school I am trying to be a part of - it makes me very uncomfortable. When this was told me over the phone by the principle, who wanted to know what I was going to do about it, I told her what I knew - that I could not see any danger to the other children if they were happily vaxed & in fact my child could be said to be more at risk from them from virus shedding! I added that as far as I was aware it was not unlawful to not vax (although it IS unlawful not to go to school or receive schooling) & that the UK & USA both provide exemptions. Her reply was " Our school does not follow UK or USA rules but BVI rules " . However, bring your child to start school Monday. " So from this I hope she will be OK with it if I can actually find out WHAT peice of paper she needs to clip onto her forms to send into the Health Dept or Education Dept or whatever deals with this. I hear you about the medical reasons - I was couching it more in a personal manner. So is it really true I can claim religious exemption without going into details? There are a couple of states in the US that drill parents, like New York. But since the principal doesn't have the law in front of her anyway, I would refuse to give details until she can prove otherwise. Since she's clueless, the more you are confident that you are within your rights, the more chance you'll get them. If asked, just state that you are not required legally to discuss your religion. Let her prove otherwise. BUT since this is a unique situation, I think you should go overboard making the principal your friend so she wants to accommodate you, not the complaining parent who has no faith in the vaccines she demands of you. Make her want to tell that other parent to back off. I'd take the approach of "here's a legal statement from me for your files to show you are abiding by the law." Forget that no one seems to know what it is. If they did, she's covered and that's all she should be concerned about. Yes, I agree it is wisest to get the principle on my side. She just does not want any issues & needs to fill in the forms in whatever way is required. My thoughts are that I need to do most of the research myself so that she does not have to feel I am a burden. I do not know for sure which parent in this small school 'reported' me but I have strong suspicions it is a lady who works as occupational therapist for the Govt & somehow feels compelled to do this 'for the public good'. If anyone is concerned about law-breaking on this tiny island I would think not going to school is a bigger issue than HOW you go to school - so why go out of your way to try to ban someone? So, I imagine it will be very difficult for the principal to find the law, too. I'd just get that statement to her ASAP and tell her with complete confidence that this should take care of it. The less time spent on it, the better. And maybe even nicely remind the principal that your child's medical status is private and the school is not legally allowed to discuss ANY of it with another parent (I'd hope that's true! Surely she wouldn't argue that point). Say it in a way that puts the focus on the other parent for being nosy, like "that person shouldn't have shared personal information about me and put you in this position." Since your statement is (or should be) sufficient, tell the principal she's free to tell the other parent "It's handled." Period. Good luck!
