Anyone see this story, " Airline Meningitis Scare AirTran Seeks Fellow Passengers Of Teenager Who Fell Critically Ill With Meningitis " ? http://tinyurl.com/3yxzhv Assuming this teen contracted a meningococcal meningitis and had a horrific outcome as is often the case with this type of infection, can anyone honestly find a lawyer that would advise them not to sue the doctor in the case where the vaccine had been refused by the parent but the doctor did not have a signed refusal to vaccinate form? If it's a vaccine preventable illness, most lawyers will advise their clients to sue because the doctor " failed to provide the standard level of care " which would include giving the meningitis vaccine. If they get the vaccine and get brain damaged they are protected from any repurcussions. So it is in their interests to protect their bases and opt for the immune and brain damage that they know they are being protected for causing. The fact of the matter is that you're going to sue the poor SOB no matter what--whether or not he gives the vaccine. Can you really blame a doctor for trying to protect himself if you refuse to give your child a vaccine that is recommended by the CDC, NIH, American Academy of Pediatrics and every academic pediatric program in the free world and that he feels is important to the care of your child? If anyone feels that strongly about not vaccinating their child and disregarding the advice of such a doctor and at the same time refuses to accept any responsibility for an adverse vaccine-preventable event, why would you bother going to that doctor in the first place? After all, doctors are a relatively new development in the history of the human species and we had a big population explosion well before there was any such thing as a doctor. Personally, I now bring my kids to the doctor only when necessary such as when they are sick or hurt ... novel concept, huh? I stopped going to " well-baby visits " when my youngest was 4 months old. Unnecessary. As for signing a piece of paper to absolve the doctor of liability if my kids were to get a vaccine preventable disease... I will sign something but I will sign it making some corrections in the paperwork or the necessary changes in order for the understanding to be there that I am doing so due to an educated decision based on the fact that there ARE dangers to vaccinations (especially due to family history).
