A guardian is appointed by the court to make the personal decisions for the protected person ( " Ward " .) The guardian has authority to make decisions on behalf of the protected person about such things as where to live, medical decisions, training and education, etc. A conservator is appointed to make financial decisions for the protected person ( " Conservatee " .) The conservator typically has the power to enter into contracts, pay bills, invest assets, and perform other financial functions for the protected person. While different states have different rules, laws or whatever the meanings are probably the same. This is a link to MN's court web site and it has videos describing the process, forms needed to be filled out and probably even documents needed to be sent in. http://www.mncourts.gov/selfhelp/?page=1207 Your state may have it's own informative web sit. We did not use a lawyer for the guardianship/conservatorship when turned 18. We sent in the documents, waited for the court date, and the courts appointed a lawyer to represent . I would strongly suggest you look at your own states web site or even look at the MN one that I posted. (it would give you a better idea of what type of legal title the Mom should try to get, she knows her daughter best and she knows how much control her daughter is capable of handling on her own) I think documents needed included school, work and medical. The more documentation she has saying that her daughter does need assistance with things the easier the court proceedings will be. I would strongly suggest reading your states website on guardianship/conservatorship to see exactly what type of document the mother needs to access medical records, perhaps that might just be a power of attorney, so a conservatorship might not be necessary since that has to do with money. It would be a guardian who has the power to make medical decisions. And perhaps there are other easier options that would work better for the individual involved. But I don't see why you can't pick up a prescription for another family member. Yes, Mayo is billing , but they do that for everyone 18 or older even if they are still under their parents insurance. (I think it's dumb but it's a privacy issue according the person in billing that I talked to, and it could just be a MN law, lol) Good luck. There are two parts to guardianship/Conservatorship-- 1. Guardianship of the person, and 2.guardianship of the estate. Usually someone files for guardianship then the court appoints a " guardian ad litem " who will meet with the person and the person filing for guardianship to determine if guardianship is appropriate and then makes a report to the court.
