Guest guest Posted May 5, 2005 Report Share Posted May 5, 2005 'HIV-positive' man sues HAL for denying appointment May 04, 2005 22:12 IST Last Updated: May 05, 2005 02:06 IST The Delhi High Court on Wednesday sought explanation from state-owned Hindustan Aeronautics Ltd on a petition filed by an engineer who alleged that his appointment was rejected after he was wrongly declared HIV positive. Issuing notices to the Centre and HAL, Justice Vikramajit Sen fixed the matter for further hearing on May 25. Jogender Singh, a resident of Agra, approached the court stating that he was not recommended for training after appointed as Executive Training (Technical) as HAL on the basis of a medical report that declared him unfit for the job. Singh, through his counsel Abhishek Kumar, claimed that such a situation had arisen as the appointment letter issued in his name had contained the photograph of some other person who was also called for interview and medical test. The petitioner submitted that he had informed about the mistake to HAL authorities, who had assured him that it would not affect him. His counsel told the court that " the petitioner (Singh) was not HIV-positive and perhaps the other person wrongly shown in the appointment letter of the petitioner was positive for AIDS " . The petitioner submitted that he did know whether his photographs and that of the other person was transposed intentionally or inadvertently but the fact remains that he has been denied appointment wrongfully.
