Tamara,

 

Once you are considered disabled, you can take your 401K money out without

paying any penalties.  You still have to pay taxes on it, but you don't have to

pay the 10% penalty.

 

Income doesn't matter with SSDI.

 

Since you are in TX, check out the unemployment benefits in TX.  If you doctor

writes a note indicating that you can no longer do waitressing, you can quit and

get unemployment while you try to get a more suitable job.

No there isn't. My brother lives with him and they live on my dad's SS. It's a

mess!

If you have to resort to your 401(k) there are many instances you can use the

money without penalty. I think one is illness/disabilityTalk to a financial

expert where your 401 is help.

SSI would count it as an asset (more than $2000 and you are not eligible) SSDI

will not consider it.

Some states requite that your employer cover you wit state disability insurance.

check if you have that first. Then talk to your doctors and see if the will

support you on a state or SS disability case. Without their support, a case wull

be difficult.

SSDI doesn't start until the 6th month after you had to stop work. You can apply

earlier, but even if they find you diabled they will not pay until the 6th

month.

About 40% of SSDI claims get approved on first application withing 90 days. The

other 50% have to go through a hearing process that could take years.

The disability criteria is that you must be unabke to perform any substantial

gainful work because of your disabiliy and that is expected to last at least 1

year. They can say you can do other jobs, but that has to be based on your past

education, work experience and age. They can't expect you, for instance, to

become an accountant if you have had no training or experience. They figure it's

less likely that a person over 50 can make a transition to a different career,

so will not purse that hard unless it's something you recently had experience

with.

Fitting the criteria is only one parrt. You still cannot be able to perform SGA

(any work earning more than $940 a month)

I want to clarify the SSDI and SSI assett issue.

SSDI (Social Security Disability Insurance) is for employess/workers who are

have been disabled by illness/medical condition that * does not allow them to

work again.* Assetts (stocks, bonds, 401's, savings, etc) are * not * an issue

when applying for SSDI benefits. Read all about it at

SSI (Suplementary Security Income) is for disabled children and disabled adults

with * NO ASSETTS * - AND low/no income. Read all about it at
