Just a guess - if it's a learning disability, the school might be might be thinking about the new possible approach to identifying LDs: IDEA 2004 states, “In determining whether a child has a specific learning disability, a local educational agency may use a process that determines if the child responds to scientific, research-based intervention…†(Section 1414((6)(). Notice the word " may " . Also, this doesn't get the school off the hook for doing the evaluation as this method (referred to as RTI or " response to intervention " ) is PART of the evaluation.
