Guest guest Posted March 3, 2008 Report Share Posted March 3, 2008 Dear all, Thank you for all that you have wrote and suggested with regards to the continuing SAGA of and the incident at school. Tomorrow, it will be a week. Nothing new has been done. The boy has not been removed from school. He has been placed behind a partition where he can have no further contact with others. Boy, isn't that a REAL BANDAID of a fixer upper! (In my opinion) is healing and has permanent scars on her neck and face. The scabs have fallen off finally. Here's the latest on the administration side of things...My hubby called the Principal today. This has to be treated as the first incident for the little boy. THERE IS NO PAPER TRAIL FROM ALL THE PREVIOUS INCIDENTS WITH MY DAUGHTER AND THE STAFF!!!! WOW, can you believe it? The principal said this is the first time she has been notified of this student's agressive behaviors. We are so, so mad. I also called the state Department of Special Education today. I was told by a Special Ed. Coordinator that unless the violated some form of IDEA that I can NOT file a complaint with them. He saw nothing violated when I explained the situation to him. We have chosen to keep out of school. This was not something that we wanted to do because we feel like we are punishing her. She absolutely loves school. However, until they can prove to us that she is safe, we cannot let her return to school. In doing this, we have been instructed by the State dept. of Sped. that we can ask for a " Change of Placement " IEP. I did formerly ask for this today in an email to the school. They won't like this because this will force them to pay the bucks for to be homeschooled. We have had problems before, just in August of 2007, with them not sending home bound instruction. (She had double hip surgery and they left her here at home with no schooling for 6 weeks.) We don't think that they will be agreeing to the home school and it will be another fight on our hands. I am very upset right now, too, that the disability Law center of OK has not contacted us with an appointment date or a call from a lawyer. I phoned them last Thursday with regards to this matter and we have had 1 phone call from an advocate to take down more information. We are very ancy to get this resolved and move on. If it is a phone call, follow it up with a letter saying, this is a follow up to our phone conversation where " this " was said. Keep an ongoing log of all that is transpiring. Phone calls, meetings, letters, visits on the side, everyone you talk to. Also, I wonder if you can talk to other parents in the class who may also have had some problems with their child and this boy. I wonder if you could talk to the boy's parents. Perhaps they have been asking for more support/help for their son and not getting it. You could help each other. As for keeping her out of school.. you are keeping her safe, making a statement, and hitting them where it counts.. in the pocketbook. They don't get funding on the days she is out of school. Although there IS a deadline as I'm sure you know and you'll have to have the placement changed to homebound services by then. Keep it up, and our prayers are still going out all involved in this. I’m trying to think from what you told us of any IDEA violations Years ago a similar incident happened to a friend of mines child. She got me involved, as she didn’t know what to do. I had her immediately call an IEP meeting waiving her 10-day notice. I brought a tape recorder the table was stacked with many administrators so she was so glad I was there. We had another friend who helped us also ............ she wrote up all the state complaints from the violations at the meeting. Anyway we wanted a copy of the incident report, we wanted her child moved to another classroom and we wanted the truth. I felt so bad because the child who was disruptive really should not been in this class and his mom was fighting the school also for his proper placement and help with his behaviors. It was so long ago but I do remember she got all she asked for after the compliance monitors came to town Hiring an attorney is tricky in many areas, rural areas don’t have them, sometimes big cites as in MEMPHIS don't have one, the state protection advocacy didn’t want to represent school issues sooooooo we really had to rely on ourselves or other parent advocates. You are doing such a great job that my only advice would be call an IEP meeting, add this to your paper trail and if at the meeting there are any infractions file a state complaint. Right now in our news our lawmakers are trying to fix a big mess here, an elementary girl with autism was sexually abused by another sped student (many times) on the bus. The school did not notify the parents said by state law said they didn’t have to because of the confidentiality laws. Lawmakers are working on changing this. I’m checking into this story to see what is up, I’m also contacting our county to see what its policy is on this issue. I may have to get it into print on Sara's IEP that they have to notify me of every incident and I will I'll be back on that story ............ You might ask the doctor if this is something that childrens services should know about. My daughter walked off school property last year, ended up on a neighboring pool deck, naked and ready to take a swim, was known to be missing about 20 minutes and no one called the police. Someone reported it to the department of childrens services - school was found not negligent but at least they know someone was looking and it is on file with another agency. You could also call your local ARC. They can at the very least give suggestions. I know these situations are stressful to say the least. It is one thing after another ever since the incident last year. I'm so fed up about our school situation and am now having trouble with anxiety. So I really do feel for you. Hope I helped a little. I guess it is helpful to know we're not alone in any of this. Like I've been saying to people lately, (you know how everyone thinks you are a saint and all and they say you have your hands full) I say that 's not hard its the rest of the world's interactions with her thats hard. Guest guest Posted March 4, 2008 Report Share Posted March 4, 2008 when Nic was 4 and in a special needs preschool, I walked in on one of the aides verbally abusing a child. The boy had autism and the aide was screaming in his face. The next day I stepped inside the building while picking Nic up to find her screaming in Nic's face as well. I flipped!!!!! I reported her, called an IEP for a change in placement. I demanded they send him to a private preschool at their expense, the director said no way so I handed her a prewritten request for Due Process. As soon as she read it, she said " what do you have in mind? " (as far as a school.) They did not want to go to due process. They sent him to a private school of my choice at their expense. I also didn't return Nic to school because I wanted in writing that they guarantee his safety and freedom from verbal abuse, which they wouldn't write because it would look like they were guilty. They said the same thing about this being the first " incident " report against this aide when in fact the other aide took me aside to tell me SHE had reported the woman on several occasions before I did-but no one documented it. The aide who did the reporting had her job threatened. Once they realized they could be sued if I* pushed the issue, they transferred the abusive aide to the building where the main offices were and I heard she was eventually " let go " .
