THE PATIENT needs to contact the Oregon State Bar and ask for the procedures for filing a complaint and to let the attorney know she is doing this.

Important to remember that this is a beef between THE PATIENT and her insurance, THE PATIENT and her attorney; this is not a threesome relationship.

Subject: Attorney Contract

I have a PI patient who was injured in 10/07. She has expressed much

frustration with her attorney because he/she has not returned any of

her phone calls and she is desperately awaiting payment for her lost

wages (single mom with four kids). I do not know this attorney and am

not sure how to advise her. Any advice is greatly appreciated.

....or she could start calling around to find another attorney, which she's probably going to need to do anyway after a complaint to the OSB.

Re the lost wages, to get them as she goes it has to be under PIP, which means she has to be disabled for 14 days, get a note from a doc and a note from the employer saying when she would have worked and what her hourly rate is. If PIP denies, the next step is PIP arbitration or litigation, although with a 10/07 DOL, you're not past the 6 months for attorney's fees to vest which means the attorney either tries the case for free or her max upside is less than all of her lost wages.
