How about a notary public? Is there one nearby who you can 'rent' for

a half hour or so?

It seems as if its right up their alley.. as its similar to witnessing

a signature, legally.

get started early in the morning.. If you ABSOLUTELY cant find anybody

else, do it yourself and take lots of pictures as you do it.. Then its

your word against theirs.. Id suspect, but I'm not a lawyer..

These tests are expensive.. but if you really did get sick, you need

to do it or there is probably a much slimmer chance that your legal

case would succeed.. But do it anyway. Do everything you can do to

document the situation.

If you CAN't find anyone else, and the notary isn't available, maybe

you can have the tape and ziploc bags and stamped envelope and form

all ready to go and have the building inspector witness it and sign

the form and post it with you as you walk them back to their car..

But of course, the chances are nonzero - that the building inspector

and the landlord are drinking buddies.. and that that would be a big

mistake..

This is not actual lucid advice by a sane human.. I am a duck..not a

lawyer.. I don't play anything on TV.

No matter what they say, they will try to equate " no code violations "

with " nothing wrong. " The two are not the same. They can say, " I

don't see any mold " but that is not the same as " no mold " or " nothing

wrong. " Whether it is the health dept or the code dept, they only see

what they are authorized to see. YET, they give the impression that

the only thing important is what they see.

The worst are the ones that equate " indoor air quality " with just one

factor such as dirty carpets, dusty furniture, forced air systems.

Indoor air quality is a combination of many things. The Indoor Air

Quality Association has identified 15 separate core disciplines, for

example.

Finally, none of the above says anything about what you are exposed

to. But they will lead to you believe otherwise. So challenge them on

these points.

I guess each state is different. I have had experience with both the

Health Department and the code enforcement people. My first

experience was with the Health Department. They did find mold in a

rental that I couldn't find, but they didn't do anything to help me

but this was back in 1998. I did move to another place that

eventually had mold from a roof leak. I could also smell mold in the

air system. We finally called the county and the code enforcement

people came and were going to condemn the place if the landlord did

not put on a roof. We were moving anyway but I wanted to report the

mold problem. He did have to hire someone to fix some of the

violations and a new roof. I got out before the roof work.

It will be interesting to see what Code Enforcement

has to say, and what they do. Back in 2001, a tenant

in this apt. building called the Code Enforcement

Office about mold in the basement of the building, and

when the Code Enforcement Officer came here, the

Maintenance man and the Officer had an argument in the

first-floor hallway, right outside my apt., because

Maintenance would not allow the Officer to go into the

basement. The Officer left, and later that day,

returned to the building along with another man, and

the Regional Property Manager, and went into the

basement.

The Officer, did a Visual Inspection, and determined

mold was present, and gave Management a month to clean

it up. That was at the end of Sept. 2001. When the

month was up, she gave Management an extension, then

another extension after that.

In the meantime, Maintenance washed down the walls in

the basement. That was their way of getting rid of the

mold.

The Officer returned during the middle of December

2001, to re-inspect the basement, and after she did

another Visual Inspection, she determined all the mold

was gone.

That, I found quite interesting, because after the

Officer left, Maintenance forgot to lock the door to

the basement, so I went into the basement and took

pictures of the mold that was still on the walls.

To this day, I still have wonder excatly " what

happened, " between Sept. and Dec. 2001, to make the

Code Enforcement Officer change so drastically. In

Sept. oh, there was mold in the basement, and

Management had to get it cleaned up, but then in Dec.

even though mold was still there, the Officer claimed

it was all gone. Something " very strange " if you

ask me!

Hope you have better luck with the Code Enforcement

Office where you live, than we had here.

Also, have you considered using FedEx to send your

samples to the lab. That's what I did.
