This link mightprovide some information. I found the ‘exemptions’ interesting. s. fuchs dc QUESTIONS AND ANSWERS ABOUT THE DIETITIANLICENSURE LAWCHAPTER 4759 OF THE OHIOREVISED CODE http://www.dietetics.ohio.gov/faqs.stm From: [mailto: ] On Behalf Of Christian MathisenSent: Wednesday, January 16, 20088:42 AMOregon ChiropractorsSubject: Fw:Dietetics Board Rule Would EndDC Nutrition Practice  Hi All,Those of use who are involved in helping our patients tobetter health through nutrition will be alarmed by the proposed legislation in Ohio. It will virtuallyeliminate the Chiropractors' right of helping patients through diet, lifestyleand nutrition in Ohio.If it happens there, you can bet Oregonwill be on the next hit list. I urge everyone to read this, sign the pledge and faxin. Christian Mathisen, D.C.3654 S PacificHwyMedford, ORcmathdcjeffnet (DOT) org SBN: DieteticsBoard Rule Would End DC Nutrition Practice Dr. Mathisen,The subject line of this email is the heading on the Jan 3, 2008 news releasefrom the Ohio State Chiropractic Association (see copy of the message below). Read it (see below) and then I have a favor to ask you. Would you look atthe attached forms and sign the intent to commit? Last September the ACAauthorized individuals to take the steps necessary to forma new Chiropractic Board of Clinical Nutrition (CBCN) and will bevoting in February on recognition of this Board. Currently, there is no Chiropractic specialty board in the discipline ofnutrition to show everyone, from patients to politicians, DC’s are trained, specialized in and use nutrition in practice. Without a CHIROPRACTIC specialtyboard in nutrition none of us may be doing so in the years tocome. As you can see by the Ohiolegislation (and there have been and will be other states with the same fight)everyone now wants to control the right to practice nutrition. If ithappens in Ohio,it can happen anywhere. Chiropractors really do need to have a ACAauthorized official nutrition board. By the way, Jeff Ware DC, DABCI, aDean now at Logan College, presented testimony in Ohio for us. He and a few other DABCI'sand DACBN’s have signed the Commitment/Intent letter and I hope you will too. If you have a DACBN or DABCI or Master’s Degree, you will most likely have theone time opportunity to be grandfathered in without taking a test. I thinkthis opportunity is available until November 2008. IF YOU DON’T HAVE A DACBN, DABCI or Master’s, it would help us all if you wouldsign the intent to commit and just check the box that says: √ ** I believe itis in the best interest of the Chiropractic profession to have a CHIROPRACTICspecialty board in the discipline of nutrition. It doesn’t cost anything to sign the Intent to Commit form and there is noobligation to join but we do need some numbers to show interest so that ACAwill move forward to help protect our rights to do nutrition.Downloadthe Commitment FormDownloadthe Guidelines for Grandfathering Diplomates in the CBCNPlease copy, check appropriate lines and thenfax to 940-565-6655 Sincerely, Dr. Van Merkle Unsubscribe me from this mailing list January3, 2008 Featured Information Dietetics Board Rule Would End DCNutrition Practice Calendar of EventsJanuary 10OSCA Board MeetingJanuary 19-20February 9-10March 1-2IAMA Acupuncture Course In-PersonCourse 1Official OSCA Training CourseColumbus, OhioFebruary 14OSCA 6 hour Seminar SeriesBusines of Care/IntroMarch 15OSCA 6 hour Seminar SeriesThird Party PayApril 5 OSCA EDX CouncilAnnual SeminarApril 10OSCA Board MeetingApril 15OSCA 6 hour Seminar SeriesTransition to CashMay 8OSCA 6 hour Seminar SeriesWellCareJuly 10OSCA Board MeetingSeptember 12NCBE Acupuncture ExamColumbusSeptember 13OSCA 6 hour Seminar SeriesBWCOctober 17OSCA Board MeetingOctober 17-19 OSCA Annual ConventionNovember 13OSCA 6 hour Seminar SeriesRehabDecember 6OSCA December12 hour Seminar CA Training DConlineCA Training Course Acupuncture Training OfficialOSCA Training Course Quick Links... OSCAWebsite WellCareRevolution Website WellCareRevolution Newspaper Advertisements WellCareRevolution Marketing Kit Order Form · Dietetics Board RuleWould End DC Nutrition Practice A rule filed late in December by theOhio Board of Dietetics would effectively end the nutrition practices ofall Ohiochiropractic physicians if enacted. The rule, 4759-2-01 would prohibit DC's from identifying risks ofnutritional problems, purposely planning actions with the intent ofchanging a nutrition- related behavior and monitoring outcome indicatorswhich are relevant to a patients nutritional goals. Each of the activitiesare individually and collectively defined by the rule as the practice ofdietetics. " To say this proposal goes beyond over-reaching is an understatement, " OSCA Executive Director Woody Woodward said. " Beyond ridiculous is amore accurate description. " " The way this proposed rule is written, recommending a vitamin, asupplement, even suggesting that a patient cut out fatty foods could beconsidered 'an action to change a nutrition-related behavior.' It isreally clear here that the dietetics board would like to stop DC's fromdoing all of those things, " Woodward said. The dietetics board and association have said as much during the lastyear. In a letter last February, dietetic association legislative chairPat McKnight said, " the chiropractor should provide basic nutritioninformation to the patient and refer the patient to the dietician formedical nutrition therapy. The chiropractor's education does NOTqualify him or her to provide medical nutrition therapy. " This proposed rule goes even further, as it substantially broadens thedefinition of dietetics, including anything more than a basic discussionabout nutrients. Recommending supplements, vitamins or changes to dietwould clearly fall outside the practice of chiropractic according to thisrule. " This is an attack on chiropractic, an attack on our scope ofpractice which allows our members to provide nutritional procedureswithin the context of chiropractic care, " Woodward said. " Wewill do everything in our power to stop this rule from ever takingeffect. " The OSCA has already had discussions with the Ohio State ChiropracticExamining Board, an academic dean at Logan ChiropracticCollege andofficials with nutritional supplement company Standard Process. All arealarmed by the potential impact of the rule. The OSCA has also reachedout to other members of the Ohio Healthcare Provider Coalition seekingsupport of its position from other primary health care providers.A hearing before the dietetics board is schedule for January 25. The OSCAis working to coordinate testimony opposing the rule. If approved by thedietetics board, the rule would be considered by the Joint LegislativeCommittee on Agency Rule Review at a date to be determined. · Thank you for takingthe time to read this important message.
