Couple wants what they paid for

Instead of celebrating the holidays in their new home, a Fremont

couple is afraid to move in because of concerns over mold.

Their concerns over mold and workmanship led to Terry and

Lafavor's lawsuit against Fremont Homes.

They wanted the fresh air of living in the country but it's

breathing inside their new manufactured home that has the Lafavors

afraid of moving in.

The Lafavors claim mold in their brand new modular home grew from

water leaks when it wasn't properly covered during installation last

spring.

Health and Humane Services tell the Lafavors not to bring their

grandchildren into the house because mold is still growing there.

The county health report says mold is present throughout the

structure and recommends they hire a cleanup crew with hazmat gear.

The $140,000 modular home is put together in three sections. But a

gap in the floor is just one of many things making them uneasy about

moving in

The Lafavors point out numerous cracks in the walls and ceilings and

the gap where sections of the modular home come together.

The Lafavors say it's not worth the money they paid.

The response filed by the attorney for Fremont Homes claims the

Lafavors interfered with and frustrated completion of work and

repairs on the home. The attorney says any damages are caused by the

couple delaying and frustrating the company.

The Lafavors say their dream of country living is still alive but

the view isn't the same from a new home they've paid for but can't

live in.

The couple is also suing the manufacturer of the module home --

Chief Industries.

Chief Industries denies its construction is defective and claims any

damage would be caused by the dealer's installation.
