Guest guest
Hey!Well, first off - MAJOR congratulations on the breakthrough! My late mother suffered something AWFUL from psoriasis - and as you know, the suffering is emotional as well as physical. She had it from the crown of her head down to the soles of her feet. I don't know about getting a patent - only to say that it could be worth your while to investigate the services of a good patent attorney. As to the moral dilemna; girl, what on EARTH is wrong with making a living at a good accomplishment??? That isn't greed - that's just plain sense!! Why, it's what America is based on!! (This makes it your patriotic duty to patent it, you know...)! You GO, girl! Ev This is a little brag and a request. After fooling around for years and years I finally mixed an herbal ointment that really got rid of DH's very bad psoriasis that he has had for over 40 years. He now has real skin growing and it is the most incredible thing after seeing the red scaly skin for all the time I have known him. I am overjoyed! My question is does anybody on here have any experience with the Patent Office? I would like to patent this ointment. I am having a moral dilemma about "am I being greedy" in wanting to keep the formula to myself, but I will sort that out as I go. Thanx for listening to my brag! I still can't believe it myself and I see the evidence every day! Gayla
Guest guest
Hi Gayla, I have a skin condition and would be willing to be a tester for your product. Let me know if you would like to try your formula on something other than psoriasis. Guest guest
Thank you Kelvin. I will check out the links when I have time in the evenings. I am in central California, so not too far. Thanks for the attaboy on my attitude - sometimes I feel like I am " supposed " to give it all away. After all, it was " given " to me, albeit with many hours of study and thinking and trying one thing after another. Gayla Re: Patenting experience wow! congrats gayla! the IP (intellectual property) law firm i know who comes recommended in a venture capital group I visit on occasion may be of help (or at least tell you whom to go to if not them)... lemme look it up when i get back home (at parents' place right now), and will send you the info (direct email). the IP law firm typical deals with technology patents, that's why not sure if they can specifically help you. BUT they know their stuff in tech... and i'm sure they have other divisions that can help you in your field. gayla, you REALL NEED to NOT look at anything you seek to protect as being greedy... in this society, you need to have business savvy (protecting one's interest) so that you can gain favorable position (financial independence - the ideal), so that you may CONTINUE to help the community/world, and even more so in a bigger way when you are in a higher position on the capital scale. money is part of society... how that tool is used for better or worse, in sickness and in health, til death do you part... ... to help the masses or hoard to your own... is alllll up to you. the fact you have an tinge of reluctance that this MAY be viewed as a " moral dilemma " only shows that your heart is in the right place, and god-willing, you will help many more in many more ways when you reach higher financial ranking. sorry for the li'l soapbox talk... in the meantime, look to put your formula on patent pending mode for about $100 IMMEDIATELY... to protect your idea/formula. also, have you considered testing this on other people as well? one person is a great win... many more would be even BETTER! go here to directly " patent-pend " your product: http://www.uspto.gov/web/offices/pac/provapp.htm go here (or google for more) to find out how this will help you: http://www.nolo.com/article.cfm/objectId/75EE515D-3C27-4165-AA54D4EEDA1C1DD0/310\ /101/134/ART/ email you directly w/a referral soon! Guest guest
What an incredible accomplishment! All you have to do is go is submit the forms from the US. patent office which can be downloaded. Send all paper work certified along with the fee requested. All patents are based on the date the mail was posted, not received. Each field has different fees to start the ball rolling. Normally it will cost $2,000-$8,000 dollars depending on the research needed to verify no other patent is pending for the same ointment. If a lawyer represents you it may cost more. My advise is to only see a patent attorney in the medical field if you feel an attorney is necessary. The Patent Office will want to see that all of your paperwork is legally copyrighted along with the chemical breakdown of each ingredient. Also, all test results have to be submitted, so they can replicate the formula and test its accuracy. As well, you will need to go in front of a medical committee about six months to a year after the Patent Office acknowledges your application. Once the research is complete (varies in time), financial backers are absolutely necessary. Testing may take four to seven years before the FDA allows manufacturing. I tried to keep this brief as possible. No....You're not greedy. You're helping others and are being compensated for your efforts. Don't get discouraged, but stand firm with your accomplishment. Again, congratulations!! Keep us updated. Debra From: Gayla <aeranch@...>health Sent: Saturday, May 2, 2009 8:08:59 AMSubject: Patenting experience This is a little brag and a request. Guest guest
I have lichens sclerosis on the body. It is an unusual autoimmune skin condition and usually presents on the vulva only. It started there for me but it is not so much of a problem as it is on the body. I have tried working with Gloria Gilbere for a year, I go to a mindbody therapist, I don't eat gluten, pasteurized cow dairy or nightshades ( I do eat very small amts of tomato sometimes). I also do not eat sugars except for small amts of dark chocolate. I do not eat potatoes, corn or oats or grains. Occasionally I have a little brown rice. And I am a vegetarian. I am about to meet with someone who works with essential oils for healing. I have had two skin infections which both required antibiotics. I. The dermatologist wanted me to go on drugs that play with the immune system and I said no to that. I did not know about colloidal silver then. I now spray it on my skin as needed I had psoriasis as a teenager and it went away when I was in my 20's. I still don't know why or how since that doesn't usually happen. My brother has psoriasis on his legs and arms and other members of my extended family have it also. Michele Exactly what is your skin condition? Have you been diagnosed with something specific? Guest guest
Gayla, you should check out the FDA website. There are different guidelines for external products and herbal remedies. Four to seven years is really not that long.. One may market their remedies prior to getting a patent as long as it is disclosed that it isn't FDA approved or it is pending approval. The American Medical Association will want to see results with pictures of before and after with a time frame no less than four years. Follow your heart, you'll know what rings true for you. Guest guest
Hi Gayla, looks like you have had some great feedback about some requirements for your new product from Debra and others! Sorry i haven't had a chance to fish out the reference # for the IP lawyers... like i said, they're a lawfirm that has other departments ... your product MAY be an area they specialize in. if you're still interested after reading up on all the helpful feedback from others, lemme know and i'll find that info. as long as you have your legal basis covered, i think it's gonna be equally important to get a marketing plan built up around your product. from what i've read... it looks like you have a few candidates willing to help test out your product and provide potentially great feedback and testimonials which can definitely help the (online) marketing too! lemme know!
