Last thing I heard was the baby pool she had open was closing. I made sure I got my bet in. I know what you mean about no one wanting to take the case. Totally different thing but we thought about suing Nissan because I got in a car accident and slammed into the side of a jeep grand cherokee with my nissan quest (brand new might I add) going 55 miles an hour and the darn airbag never came out. But everyone said OMG the airbag shouldve came out thats rediculous but then right after they said that they said it would be too costly to sue! Soooo needless to say we didnt. I am glad to hear you are happy with your decision to band Dane. I cant believe the hospital told you to lay him on his right side. They might as well cast him with the plagio wand! Jeesh! Our peds office said that we should sue the Cleveland Clinic for telling us to only lay Dane on his right side (this from the #3 hospital in the country - phooey!). I have contacted a few attys, but nobody wants to help. They all said it would cost more in legal fees to prove all of this than we would win back. Because he got such great improvement, compensatory damages are out of the question and we wouldn't want to ask for anything beyond what we paid anyhow. They all have said if he didn't get the band and didn't get correction, they would have taken the case in an instant. > If we never get our money back, I am still very pleased with our decision to band him. I am in Houston, Texas and would appreciate any information on attorneys to contact to discuss my case. My daughter was not referred until 13 months (after I consistently asked about her head not being right) and then the neuro she was referred to said that her palgio was not that bad and the band would not do much at this point. He also said the band was torture and he did not think she needed it. Now I know she could have gotten correction at that age and now that she is 29 months I am so mad she did not get the treatment she needed. About your talking with attorneys, dh & I also have an issue with our house (long story) and a lovely newly found termite infestation. Anyhoo, we have been considering suing the previous owners whom we have evidence were aware they had termites when they sold it to us, but didn't disclose the information to us as they legally were required to do. Anyhow, attorneys we've talked to have told us the same thing, that we'd pay more in legal fees, than what we'd get in return IF we won the case. So we're now considering small claims court, don't know if youcan do that with an ins. company, Dr's or whatever you'd do, but thought I'd throw the option out there to you. I think small claims is for amts less that $5,000. So you'd fall into that category. Just an idea! Hope everything else has been well with you & the family! Glad to have you back. That was what we were advised to do when we were consulting attorneys about 's helmet. You can only sue for up to a predefined max, but anything would be better then nothing.
