I know...I'm just a very passionate person!! And Lord help the one who DOES

try to mess with my babies, whether they be 2-legged or 4!! I just really

get upset when people try to take advantage of others, you know!!

And my darlin' Sage, you could NEVER be my enemy...psychotic stalking

victim, yes...but never an enemy!! I truly love all people, some just more

than others!!

After you just went around TAKING what was not yours to take and offering

them for sale, what was not yours to sell. You say you paid $55.00 for them

As far as EBay goes, people are trying to sell their kidneys on that site,

and as long as they get their share, I don't think EBay really cares, do

they?

Makes me wonder...anybody got an extra uterus for sale??? I lost mine 10

years ago, and it's kind of hard to have a baby without one!! hehe Or I

have a VERY used pancreas that I'd be willing to trade for a new colon...any

takers?

i just had my 5th boy i will GIVE you my uterus and any other reproductive

Just to clarify this, anything typed or written down by the original author

is protected under copyright law.

You legally secure your copyright by submitting a copy of your work with a

fee to the Library of Congress.

There is what is called " Fair Use " clause in the U.S. copyright law, stating

that material may be quoted from verbatim (that is, word for word) if it is

to be used for the purposes of education, research, critique or review.

What is allowable under the Fair Use clause is determined by the " purpose

and the characted of the use, and whether such use is of a commercial nature

or is for non-profit educational purposes " , and " the amount and

substantiality of the portion used in relation to the copyrighted work as a

whole. "

There are separate exemptions for libaraies and archives.

I will be the first to admit that I have forwarded recipes belonging to

other people without giving proper credit (which is bad netiquette, and I do

apologize)! But I don't believe I have breached any copyright laws by doing

so, as they were posted for educational purposes and I have not sold the

recipes as my own or profited from them in any way.

Of course in the future, we should all make an effort to give credit where

credit is due on any recipes posted! :-)

No Melody you stay on your soapbox you have a right to go off as so dose the

others. It reminds me of being in school and thats been alongggggg time ago...of

someone sitting behind you and copying your test paper.

Hi All,

someone else to copy it and sell it for profit or even to cover their

costs, it should be passed around freely.

I will have second thoughts about posting recipes on lists again, I

would not like to add to their next lot of recipes, and free money.

But what really gauls me is that they advertize it on our own lists.

DH is a journalist, and he has advised me that " If it is published "

and " putting it on the internet is classed as publishing it " it is

automatically copyrighted he checked this in his McNae's Essential

Law for Journalists

To All:

I replyed to the message where this person wrote in saying they had gotten

the recipes off the internet for $55............

I see now that I was replying direcectly to them and not the group. What I

told them was after they sold 2 3/4 orders they would have to stop selling

as anything more would be profit that would, of course, need to be reported

to the IRS.

If copyright laws are in fact being violated then making a profit would be

prohibited.

If I am not mistaken, the parties being effected can file a complaint with

someone on the web who regulates the type of business being put on the web.

Maybe someone out there is familar with this procedure.

The other thing I might suggest is to file a complaint with the FCC in

Washington DC. I believe I still have an address for them if you are unable

to find it in the web yellow pages.

Sorry for all the grief this is causing as I, for one of many, enjoy greatly

the info being shared on this forum.

Again I will say that if there is a violation on E-bay, then I believe the

FCC would insist that E-bay investigate the wrong doings. For those being

effected contact E-bay about your recipes being sold for profit. Go to the

source.

You make a very valid point. I, too, wonder if any laws other then moral

have indeed been violated. But if they have, I have given my thoughts as to

where to complain. I realize this group is a good place to vent but that is

all that will get done here-just venting. If one believes they have truly

been voilated then one must go beyond this group.

Just my thoughts.

To All:

One has to pay for a patent, as Cat says, or it is free game. Look how many

time in the past that one has invented a great product and selling it on the

market but didn't get around to buying the patent on it. Someone else came

right in behind them, created the same or almost the same product and put a

patent on it and made millons from it. I wish I could think of an example

but I know from reading I have done that it happens.

As for copyrights, I know that in quoting, one must name who made the quote.

I am sure that is the same when reprinting a recipe that has not been

copywritten. If all of you have copyrights, and I mean paid for your

copyright and completed all the legalities, then persue the matter or stop

complaining.

I am not trying to argue with your feelings but rather looking from the

outside in.
