Not to become rich but to pay off the thousands I owe for medical bills that I can't pay.... the hundreds in meds I take monthly.... the pain and suffering my son and family have had to endure as a result... Bitter - YES I AM!!! It is hard not to be in this situation. I also had a high paying job that I am on medical leave for now. They have instituted a new addition to the employee handbook that anyone requiring to take a leave of more than 6 months is automatically terminated. Sad but true. I don't even know if they can do that but they did. I am approaching 6 months in the next week so I am freaking out about it. I am the same as you - had my doctor told me any of this crap I wouldn't be here now. I wouldn't be $50,000 in debt in credit cards and I would probably have another baby which I sorely long for but probably will never be able to have. As far as the statute of limitations go, I am a little foggy. I think it is from the date of implant or the first date you realized they were making you sick. In my case I was implanted 8 years ago but only realized that they were the source of my illness around Feb 2003. In this case I should still be able to sue but the issue is getting an atty to take it. My implants were faulty - bad valves. Both were overfilled - both were reused back in 97 when I had capsular contracture that required another surgery which Dr. Blais said was a big no-no. I have a ton of garbage on my original PS but they Atty's are in it for the $$$$ so if they think it will be difficult or expensive to pursue they back off. That is too bad in this day and age of people suing every Tom Dick and Harry over stupid crap and winning. I am not sure how Medicare works, but I had united at the time and if I had severe capsular contracture or could prove ahead of time that they were leaking they said that they would cover it. I think it depends on the doctor you go to but mine did everything in his power to make sure I won my appeal with my insurance co as both my implants were leaking. I had three different operation due to complications and on each he referenced overfilling. I just don't get it. maybe this is normal practice? I am not sure. Doesn't make any sense to me to overfill them. Seems like you are asking for trouble. That was actually noted in my report from Dr. Blais when he analyzed my implants that that was not a good idea. So be it. I tried a ton of lawyers down here and none would get interested. My implants did not show visible signs of bacteria or fungus. However...you never know. My symptoms were more like silicone symptoms than bacteria ones as well. Now...I feel so much better that there is no doubt it was the implants. I don't know why or how but it was the implants. I had them for seven years so they were probably just breaking down inside me or my body was just fed up with them. In the last four weeks (since explant) I have been losing weight as well. I have not really been exercising...which I used to...because it is finals time at school. I have been eating the same and drinking the same amount of water.
