Guest guest Posted September 15, 2004 Report Share Posted September 15, 2004 Beth I am not sure what state you are in but I know an atty. down here that would handle it but it would depend on the details - since you are already three years out that may be an issue w/ statutes of limitation. I had a pretty cut and dry case - both implants had faulty valves, both were leaking, I had been through 2 sets, my doc operated in his office under conditions that were not up to code, my child was affected, you name it but since I was 7 years from implant it was difficult to pursue. It makes zero sense to me as I only found out a year ago why I was sick but there were some other issues too. The atty's will try to take it only if they think they will get a very large settlement as it will cost so much to pursue with this very "touchy" subject. My Atty. told me my case was very winnable, without a doubt, but they weren't sure how much $$$ so they didn't want to get into it. Sad but true. I am still looking. I also know of another one that is very knowledgeable about implant illness in Fla. I spoke w/ him and he said that I would need to have extensive testing done on my son to prove he was affected so then he could pursue it as that would be a way to extend the statute on limitations but I don't have the money to get the testing done. Does the statute of limitations start the day you have them implanted? That can't be if you aren't sick at the time. If you are thinking that I'm all about the money you are so right. I lost my high paying job and currently have absolutely no way to support myself. I'm 43 years old. What does the future hold for me? Nothing! I am in the process of moving in with my sister but she has already informed me that I should start looking for low income housing. I'm bitter, bitter, bitter. The only person in my life that hasn't turned their back on me is my Mother! If it comes down to me living in low income housing I might as well just end it now. I'm tired of being sick and waiting for doctors to see me to take more tests that just turn up negative. Tired of hearing that my implants can't be causing my problems then I get a report and hear that the doctor supposedly told me they can cause autoimmune disease. He never told me that danger because if he did, I wouldn't be in this situation right now. If your son is also affected by these damn things then they should be taken off the market like the silicone implants were. Although I have a friend that just had a masectomy and was given the choice of either saline or silicone. I told her of the dangers from both. She felt that she was safe, as we all did in going with the saline.
